Different situation, but I did the same to a chap getting out of the passenger door. He was in shorts and my bike was brought to a rapid holt from the braking action against the back of his leg. He was hopping around the dual carriage way with a bloody great burn to the back of his leg...ouch
As a cyclist myself. I dam well hate it when people don't look.
I have got myself a set of lights that flash like a police head light, so for me when doing what you did I often get cars moving to the right for me :)
Only this morning a woman in a vuxhall pulled out infront of me, I nearly crashed into her car -.-
the person who is really at fault here is you! by broadcasting footage of a child without parental consent , along with her parents registration and car type, im sure this is illegal, i mean, that could get nasty, highly unlikely tho, but still! the potential is there kid!!
No need for consent. I have consulted with the information commissioner for Scotland to clarify this. Anyway the video is of low enough quality that the girl is not easily identifiable. What is wrong with displaying car reg numbers? Could you find out this persons adress by legitimate means?
Please feel free to contact the police if you feel justified.
Are you sure? When you make a televsion programme you have to get consent forms from the people you are filming if you are going to broadcast. Obviously not the people milling around in the background, but if they are the main content, then you do. There are lots of "set ups" that never get shown on shows because they can't get consent, think "trigger happy TV" or "phonejacker".
BTW the video is another good example to why you shouldn't squeeze down the inside of cars.
Absolutely certain. I have had an e-mail discussion with the Information Commissioner for Scotland about this, and I, and other helmet camera users like me, are exempt from the data protection act as we are exempt under the recreation clause. Television and broadcast companies are not exempt and thus have to follow the act.
But you are broadcasting it. So surely it's no longer recreational use. Possibly a grey area, but I would have thought that with some YouTube videos being seen by more people than many TV programmes, this will be addressed soon.
I explain everything to the commissioner and posting it to youtube still comes under recreation. So it would appear that it isn't a grey area at all. I am more than happy to send you my correspondence with the commissioner if you like.
You do really get defensive on posts, don't you. I would say that it is a grey area and something that I'd imagine will change in the future. Can you explain to me then how people (mostly the rich and famous) manage to get their lawyers to remove videos from YouTube. Surely they are doing this from a legal perspective.
Not defensive at all. Maybe i should have pu a smiley there! Anyway even if I was defensive, it would be understandable considering some of the abuse I get (including death threats in the past!).
Youtube will remove videos even when there is no legal need to. It has happened to me before. They err on the side of caution. Also, you have to remember that data protection differs from country to country, so they have to try and work out which law covers them for which video etc!
Magnatom - is this reffering (can't spell I know) to reading out the licience plates on some of your videos? I am interested because I think it's a great idea...but what's the argument? please enlighten me....
Scott: unsure about Scotland, but what magnatom says here rings true to most places in the world. If my own country, this is also 100% legal, not a grey area. Perhaps it should be, but it isn't.
In most countries, in reality the rich get a different set of laws from the rest of us. In some countries, they can buy the judge or politicians. Elsewhere, they buy the best lawyers available and can pursue vexatious lawsuits that threaten the the victims with financial ruin.
If you have done nothing wrong, except upset a very rich person and he/she starts a lawsuit against you that is likely to cost you $20,000+ per day, just how long would you contest it? Methinks not for long!
it's if you do the videos for commercial use you have to have consent. Like phonejacker and trigger happy tv use it to make money from television that is a commercial use.
There is no law for privacy in the UK, no law against filming/photographing children, cars or people in general. The only laws in respect of cameras are based around military and government sites.
With license plates any plank will realise its not the plate/car that breaks the law but the driver - so hence what is wrong with filming the plate? I see nothing wrong in that myself.
downfader2: same for Australia - there is right to privacy. As far as number plates go, you also have to have access to the motor register to identify someone - and citizens shouldn't have that access, so there shouldn't be a concern there either.
Police Camera Action! Rules riding a bike are not the same as driving a car and you don't have to sit and wait for all the traffic to move if you can get past it.
I can't imagine it was a scheduled stop on the side of a main road like that but I do approach these passageways exepcting that to happen after years on a motorbike. They only get you once and never again.
You would be wrong in the eyes of the law then. Undertaking is perfectly legal and the onus is on the passenger opening the door to ensure it is safe to do so. Anyway, in the end there was no incident. I was traveling at a speed which allowed me to stop in plenty of time. So I was at fault for.... nothing!
If undertaking is perfectly legal then why did you put a video up of the taxi driver at Thornwood roundabout and say its was dangerous that he was undertaking you? you need to make your mind up on your rules or is it back to the old "one rule for them and one for us"
out of curiosity which direction do you go after left filtering and moving into the left turn lane? (I've not yet found any alternate route from anniesland cross down to the tunnel without carrying on along crow road, which is one of the more risky parts of the route)
I haven't got time at the moment, but I'll send you my route when I get the chance. Basically I dismount and cross at the lights a little further down (dismount of course) and head into Jordanhill. It adds a bit of time, but it avoids a lot of hassle.
That'd certainly be interesting, thanks! I did experiment a bit with going through the East side of knightswood but my best attempt so far means lots of left / right turns one after the other.
(Had the number 90 bus pull out right into my path going down Renfrew Rd tonight wearing full hi-vis gear and with a full set of lights, and that's normally one of the less bothersome areas...)
Good reactions! It's amazing how many people just open their doors without thinking... pity it's not possible for you to dent the door without falling off yourself! ;-)
I thought you never rode in the car door zone but i guess you do when its to your benefit, there is no diffrence to these cars and parked cars and like you found out you get idiots opening there doors without looking, but if you can ride in the car door zone here then why not normally?
Here I am traveling at less than 10 mph. Otherwise I can be anything up to 30mph. Passing parked cars on your left, if a door opens it will throw you into traffic. Here if a door opens, worst case scenario I end up in the bushes. There is a world of difference!
Potentially a bad situation alright! But, I (partly) expected that to happen.
I always cycle slowly (about 5 mph) along the inside of stopped traffic that is within about 4 four feet from my bike. This is to allow me time to stop quickly in the event of passenger doors being opened.
It appears that you were cycling slowly also at the time the passenger door was opened. Wise decision!
You're using a "Dog Cam" now? Much clearer video. But no date/time stamp? No audio either?
You are forgetting it not legal to undertake, cycle you are in the wrong

@devonmale69 You are forgetting that I am in fact filtering which is perfectly legal. You are in the wrong, sorry. :-)

Weird though that she is let out at a queue, where would she go? Through the bushes, or walk between the gap of cars?

I prefer to filter when traffic slightly moves! Less risk that somebody would open a door.
