I'd definitely say it was a bird if it weren't for the rest of the image jumping (flapping) up and down. You can clearly see it with the text, the graphics, the structural background. Everything is bobbing up and down. I am assuming it's scan lines perhaps? I see no way it can be determined that it is 'clearly' a bird. If it was the only thing behaving like that on a perfectly still frame, there would be less doubt I think. Of course, simplest explanation is that it 'is' a bird.
