The point is, top speed is 45....max, and he knew he wasn't even close to maximum. Which is why he said "Top speed is 45, and I wasn't going more than 35". Maybe they have listening lessons in the same place as math ;).
@ryanhayn Yes 45 is more than 40 but on that bike it takes a while to get up to speed, I've got one.. to achieve top speed it takes at least an 1/8 mile. If it was going uphill top speed would be 25-38 depending on grade.

I think that guy needs a math lesson. 40 is less than the top speed of 45, so yes, it is possible that he was in fact speeding.
