Try to think about how it works. Someone who gets captured on the ground is not captured by the policy makers but the hillbilly fighting in the war who if any good at making decisions would not have been in the army in the first place. Once captured, they are "terrorists". Not the enemy but terrorists. Its much easier and less expensive to keep one in the cell then to go through the trial process. Awhat stage of the process have terrorists been seperated from prisinors of war?
