Only the President determines who is an enemy combatant. It can be anybody. In fact a republican recently said they want "Jack Bauer Justice". You know, the character from 24? They like the idea of torture and basically extremism, more than the idea of Americas integrity, the Constitution, and our Bill of Rights.
And in this "war against terro", what is the "battlefield"? The entire world, including teh US.S> And haven't you heard about teh us citizen labeled as an 'enemy non conbantant". No. wonder why. No notice, no court, no press.
Let's say the government picks you up off the street. They claim you to be an illegal alien on non-citizen, how are you going to deny that without habeas corpus. Oh wait, you can't, you lost that right. Because they believe you too be a non-citizen, therefore cannot question your capture.
Bush has signed statements allowing him the personal ability to determine the definition of "enemy combatant" including but not limited to the theatre of battle. This means that a private citizen who falls out of favor or practices the wrong religion could and probably will at some point be labeled such. Gods help us!
