  • @PresBarack, I agree with Justices Fuller and Harlan, SCOTUS ruled incorrectly in Wong Kim Ark, due to Congress's failure enact good laws. WKA's parents were under joint jurisdiction of the US State Department and the Chinese Embassy, but neither of his parents was a US citizen.

    What if one parent was German and the other French, what right do you (USA) have to determine the child is a US citizen?

    Shouldn't the child be the citizenship of the father, or of both parents?

  • @borderraven Citizenship is a right given to you for being born here. The only people that are not granted citizenship are children of diplomats and people who are not under U.S. law jurisdiction. (Foreign Diplomats are immune to U.S. law)

  • @xaviqaz We don't need to change our constitution to fix this problem, you have many choices. 1. Deport parents with baby, the baby can come back when they are of age. 2. Leave the child with a relative legally living in the United States. Lastly, the issue with welfare is a completely different issue and in my honest opinion we need to cut back on it entirely or tremendously.

  • @borderraven Actually, according to French and German laws, the kid would be German and French, since both countries have "jus sanguis" laws, meaning that the kid could've been born on Mars and he'd still be German and French, due to his parentage.

    The U.S., however, has "jus solis" laws, meaning if you're born here, you're American.

  • @rick10is, we need laws that consider "embassy or consular jurisdiction" of the parents as affecting the citizenship of the child. The child is the joint-citizenship of the parents, not of the soil. The soil only provides jurisdiction over the territorial laws, treaties, and int'l agreements, that govern the birth.

    Anchor baby and DREAM Act reward the bad behavior of the parents.

  • @PresBarack , So far Arizona has been victorious in the courts. Of 10 cases, 8 were dismissed.

    In USA v Arizona, most of the bill was left intact, w/ Judge Bolton ruling against certain mandatory, but not on voluntary parts. It should win in SCOTUS.

    US Chamber v Whiting survived up to SCOTUS, and should win in SCOTUS.

    Wait and see by July.

    BTW - How do you define "jurisdiction"?

  • @borderraven The current case with Arizona and the case of birthright citizenship are two completely different cases. Are you confusing the two? Jurisdiction is define by that they are subject to U.S. Law. Foreign diplomat's children are not granted automatic citizenship b/c they are not under jurisdiction of U.S. law since they are immune to U.S. law.

  • @PresBarack, the mention of foreign diplomats and soldiers is only an example of "transient aliens", who cannot be drafted into the US military. Illegal aliens cannot be drafted into the US military, because they are "transient aliens" under "consular jurisdiction", thus the children are whatever the nationalities of both parents combined.

    Those aliens joining the US Army, can't become US citizens for a couple years, their security clearance is below NOFORN, and I think the service obligation is 8 years active duty.
