  • Dear Kenyans, i might sound crazy but it is alright. Three things were brought to us by the whiteman; POLITICS, RELIGION, EDUCATION. The very person who introduced this 3 institutions to us knew that he would USE the 3 to control(ruin) our lives. So please KENYANS try to find out who is this ''HIDDEN HAND''(powers) that run our lives indirectly.   • @Juluka69 My friend, fact remains the deeds where cleared by movoko county council.Secondly,the whole map changed.Airport has more ground to the north but all over sudden,they require 8km to the south.Thirdly,there was no notice,no case nothing and KPLC had installed power to the area.If there is a problem,we have a judicial system.These people were not squatters.If anyone's future is in quick sand, it is people who condone such injustices.Lets be fair and lets use the Law.Occupy parliament!!!

  • @TheMwenyeji Titles indeed, fake ones signed by a guy long sacked from the civil service for fraud, a corrupt enough guy can get an equally corrupt official at Mavoko county cncl. to sanction a corrupt deal but does that legitimize anything ? Bottom line is that U r where u r not meant to be. No notice given ? what a joke, 90days notice was given and lots of them even pasted on the KPL poles. Power poles were not on the FLIGHT PATH so that's fine. Mwenyeji do u know what Caveat Emptor means ?

  • @Juluka69 Wacha wivu, you probably have have never invested in Kenya and definitely dont know the land buying process and all the official documents that one receives and may start developing the land with while waiting for the title deed. Some people enjoy watching other people's pain because they feel they are getting company in their otherwise miserable lives.

What I know or not is immaterial but I know better than to invest in a FLIGHT PATH, my take is deal with credible pple. of calibre and always remember- Caviat Emptor

  • @Juluka69 I have flown to countless airports in US and Europe and have seen buildings so close to the flight path you can probably see someone sitting in their living room. I am not saying that people should put up buildings everywhere without regard for safety, but in Syokimau, those buildings offered no risk to planes, a better way to ensure safety was maybe to gate off the community and have tenants allowance pay for security patrol, I'm sure it would have cost much less than losing a KSH 30M

  • @erastusmovies My brother you may be the most "flown" guy but that still does not make U an authority in aviation safety. Indeed in places like Kai Tak airport(take it U know where that is) , one flies in between skyscrapers but still there's clear flight path despite the buildings U see. However the point is that the guys were on the land illegally whatever we say, a simple check at Min of lands would have told them that. Lesson - Caveat Emptor

  • @Juluka69 Bro. I am confused by your reply, first off, Kai Tak Airport in Hong Kong CLOSED in 1998, The airport was surrounded by mountains and skyscrapers 5-10k. Syokimau highest buildings were 2 floors, now if a plane is flying that low that far off the runway, we have a problem. According to the parliamentary hearings, the land and home owners followed due diligence when buying the land and followed all the proper avenues to develop it and pay taxes. Wait for report.

  • @erastusmovies You miss the point as usual, I was just jst giving the Kai Tak exmple. to show how close buildings can be to an airport n yet not in the flight path. How so sure you can be EVERYONE who bought land in Syokimau followed what according 2 u is "due diligence" beats me when it's a case of "res ipsa loquita" . The PS showed us the original title deed of the land and clearly it had not been subdvded. Any simple search at Min of Lands would reveal that, tuache short cuts

  • @Juluka69 A report tabled in Parliament yesterday by the JPC that investigated the recent demolitions be adopted and implemented by the GOK, then the victims may be compensated for their loss by the state. The report tabled by the chair of the committee, Gachoka MP Musyimi, also recommends that the government gives humanitarian assistance to all those affected. And as Chris Thairu reports, it also notes that majority of those affected may not have known that the title deeds they held were fake.

  • @erastusmoviesh, Humanitarian assistance is what the report recommends not COMPENSATION. You can not be compensated for what did not rightfully own legally and that unfortunately was the case with the Syokimau victims. For me the disappointment was that Mutava does not recommend the arrest and charging of the Mlolongo brothers who "sold" the land in the first place. Check out my post 6days ago...

  • @Juluka69 For once we can agree, I think a lot of people at Ardhi House, and the brokers who sold the land and cleared it ought to be criminally charged, sentenced and fined to the fullest extent of the law, its the only way to bring accountability and end impunity, that report by MP's was useless if it doesn't recommend such actions. Its nice having a mature conversation with someone even though we disagree at times.

  • @erastusmovies Point is not how high the buildings were, were they there LEGALLY ? answer is sadly NO and that's why even compensation may be tricky, that's the sad fact my brother regardless of what some "smart lawyer" may tell you, unless someone pays on humanitarian grounds.

  • @Juluka69 I did some homework, a one or two story building according to international flight regulations cannot be considered to be in a flight path unless build either on the runaway or one km directly infront of the runaway. None of those houses demolished did. By your argument of flight path warehouses and car hire offices at or near the airport should be demolished.

  • @Juluka69 Exactly how do you tell what's a "clean" place for buying land, if not by conducting a search at the land office? The Syokimau residents did precisely that, and the land titles showed the land as "clean".

  • @Waiswa1 In a corrupt system like ours, conducting one search is not enough, double check with the various authorities. Then common sense should also come to bear, I can guess what's KWS land, road reserve, Stadium land and so on. Because of past mistakes, many wrongs were let to be but that still does not legitimize them. Guys got "titles" for cemetery land, does that make them legal owners ? Check the location and the history b4 u buy. Again I say ARREST THE SELLERS....

Where else were they supposed to check other than Mavoko Town Council (where all the Syokimau land titles are officially kept)? And how is one supposed to know whether a given piece of land is "disputed"? By reading newspapers, listening to radio or going to bars???

  • @Waiswa1 No I don't think they went to THE MIN OF LANDS, which is the premier authority on land matters. All the OROGINAL maps and even title deed signatories can be found there. R u aware some of those guys had titles signed by a guy who'd been fired like six mths. prior, a guy who was no longer a government employee let alone an authorized signatory, that's the stuff one can find out if U r patient n not out for a quick kill which turns out into a quick descent for you.

  • @Juluka69 Actually, the "Torrens" Land Registry system used in Kenya is decentralized (i.e titles are kept at the nearest local government offices). You'd never find land titles for Syokimau (or, say, Busia) in Nairobi. The Min of Lands only keeps titles for land in the Nairobi area. Secondly, if the concerned official had been fired, shouldn't the government have put out a notice warning prospective clients not to deal with a particular individual who no longer represented them?

  • @Waiswa1 Yes, some very valid points Waswa but at the Min of Lands, one can get some info that U can not get at the councils . U can authenticate your SERIAL numbers for example and also find out who is the authorized signatory. GOK does not put notices abt signatories in the papers as U well know.

  • Dear Kenyans, there's never a soft way about this, even as we sympathize with all the affected, let's not loose sight of the FACT that the buildings were ILLEGAL . Nowhere in the world can you build on a FLIGHT PATH. So anyone on a road reserve, flight path , forest land etc....be warned. Lesson - Before sinking your 50m worth of investment anywhere, take time and VERIFY the authenticity of the papers you hold. Am sure in the government records, this land is clearly marked as airport land.

    You are right to say the buildings were illegal, but truth is the home builders did have title deeds. Someone must have given it to them. Instead of arresting the corrupt govt official you go demolish the house, wasting millions of shillings. Kenya is already poor, what do you benefit by destroying hard working people's homes? Plus it makes other people nervous so they dont invest in new buildings for fear they will be demolished just like these. Bad idea man, bad!

  • @midiafreemega Just a small correction mate, none of those guys actually have title deeds, what they have are certificates of allotment issued by Mlolongo land buying company who've of course vanished , lesson- Deal with credible companies. Any title deed if any was issued ultra vires which makes it null n void. Anyone investing in a straight venture need not worry, that's the truth. How long have Kitengela residents had their houses ? And Isinya ? has anyone demolished them ? I rest my case.

    Ok, lets say the sellers were fraudulent, why demolish innocent peoples houses? once investors see these images they get scared thinking any new buildings they erect may also be demolished coz the person who sold the land was a fraud. Final result is people are afraid to build, in a country with housing crisis! Aah the irony!

    Best solution is arrest the sellers. No one just "disappears". They are not Houdini!

Truth is notice was given, a full 90days and anyone saying they never got one is LYING, some were even pasted on the electric poles for crying out loud... this has nothing to do with Al shabab, everything to do with aviation safety.

  • This is really painful just to watch so one can imagine how it must be for those affected! Apparently it affects developments on a 4,000 acre area, makes you wonder who authorized sales on such a huge scale knowing fully that its KAA land!! This not only justifies my view that buying land in or around Nairobi is VERY risky but that the land/houses are overpriced because of the risk.

  • @nicosituma My brother no sale was authorized and that's why the whole deal was rotten in the first place. A land buying company (Mlolongo investments) conned guys into "buying" land they didn't legally own....get it ?

  • I agree the blame squarely lies with the Ministry of Land and the Kenya Airport Authority. I really feel sad for those guys, having been in a similar position along Thika road. I couldn't sleep for like a week, My wife and I had taken a loan with the hope of securing ourselves a good shelter. I was lucky the Ministry of roads compensated me, I vowed like @naidamu to buy land far away from Nairobi. I totally feel for those guys.
