I don't give a shit what the NYPD penal code says. I'm talking ethics here, not law, and to my mind a label of murder on someone that doesn't purposely instigate the death of another person is NOT just.
Entering into a situation where another person is likely to die shouldn't be enough to justify a murder ruling. That should be considered negligence, in which case a ruling of manslaughter would be far more appropriate (and only if another's death was foreseeable).
