  • One may film from one's property.

  • Some wrote that you should sue the Police. Unfortunately, this isn't going to happen as the Defence Attorney will file a Motion to Dismiss on grounds of failure to state a case (in other words you fail to have "standing" in court because you can neither prove loss, harm or injury- which is true). You may notice that this is difficult for you though, but can be proven to work if you push the issue or at least gives you very good grounds for appeal..

  • For instance, he threatened to arrest you for filming. No loss, harm or injury cam e to him and therefore he does not have the necessary "standing" (civil) or "Corpus Delicti" (criminal) to put forth a case and leaves the court without jurisdiction (not the court cares since they're corrupt to the core).

    The Police have a duty to investigate distress calls ; Sometimes this is used as a lawfull excuse for ilegal entry and searches. lawfull intention also saves lives !

  • Good for you. Cops should know the law well enough to know they may ask to not be videotaped, but may not compell compliance absent statutory authority.

    I oppose drug prohibition, but do not blame the cop enforcing the law. Likewise, I expect the cop who opposes my videotaping from public grounds of public activity to likewise tolerate me. It is inexcusable for an officer who claims "just doing my job" when making an unjust arrest to later enforce his whims outside the law when it suits him

  • @BackdoorBandit956- No need to hope. If you read "Call 911 and Die" it will show you that the Police have proven track record of not turning up when they're needed, and attacking, also sometimes killing, the person that asked for help.

    B. You tell the Cop to leave the Property if he crosses onto it.

    C. You sue them if they violate either of those demands.

  • Actually it's completely and totally legal to videotape a corporate debt collector, I mean cop. You should have gotten him to state the ACTUAL law and if he couldn't then just continue filming then when they release you and they will have to, you lawyer up and sue.

  • I believe that if public employees believe they have the POWER (not right) to video and audio record their encounters with the public, then the public should likewise have the unencumbered RIGHT to likewise record any events in public or on publicly-owned property (such as courtrooms, government buildings, and the like). That seems equitable and fair.

    And who has all the CCTV cameras, dashcams, satellite cams, and traffic scammeras? Not us. What's good for the goose, is good for the gander!

  • From what I understand from your previous vids Dave, the NH statutes are unclear with respect to audio recording, but not video recording. Is that correct?

    I believe you also mentioned that there is a bill being proposed in your state legislature that will clarify your right to record public employees in the exercise of their public duties. if I'm not mistaken, what is the bill identifier?

  • In other states they would charge you for wire tapping, resisting arrest, and probably assault on an officer for questioning their authority and asking them about the law. In NH, it seems they just kidnap you for a while... catch and release style.

  • I'm in Arizona. The cops around here are a mixed bag. The Sheriff is corrupt, but his deputies are for the most part pretty good guys. The city police are generally the type that harass and enforce, however there are some good guys on the force. It's not as bad as other places, but probably not as good as NH.

  • Sheriff Joe Arpaio! ahahaha. Pink underware and all of that? Yeah, he's just a little corrupt. I've heard some things about him. He said on Lou Dobbs, "I get sued everytime I flush the toilet!". I can't imagine why...

    RP4409 is Arizona based. Check out there Youtube channel. They've been going after all of the scameras placed on your roadways there - and just got the issue on the Arizona ballot for the next election.

  • Well, I wasn't referring to Arpaio, but I'm sure he fits the description. He's a sitting sheriff who's traveling around pitching his dumb book. I agree with some of his methods, but others stink to high heaven.

    I actually meant the Pima County Sheriff Dupnik, just south of Phoenix. During elections he's got a goon squad that runs around uprooting his opponents signs, defacing property, and threatening people. It's pretty bad. "Somehow" he always wins...

  • A few years ago Sheriff Arpaio was been deputized by the department of homeland "security" to make immigration arrests.

    He does these huge dragnet sweeps in Hispanic neighborhoods to round up as many people as he can.

    If law enforcement was serious about stopping illegal immigration they would crackdown on the businesses that are hiring these people.

    Take away the jobs and the immigrants will have no incentive to be here.

  • It's much more politically expedient to go after the brown-skinned foreign worker than the upstanding pillars-of-the-community white skinned business owner who illegally employs them.

    Sheriff Arpaio is one of the most popular public figures in Arizona.

    I suspect his popularity would diminish substantially if he went after illegal employers.

    Too bad he's concerned with the popularity contest.

  • It's a simple act of the NH legislature to say, "No state employee may refuse to be recorded in the performance of their duty."

    Privacy is for private people, in my opinion. Anyone who wants to be a bureaucrat can darned well be recorded while they get paid with tax money.

  • We need to find the actual laws and make up cards. So when the cop says stuff like that, we can SHOW HIM THE LAW. I think it would help both the videographer with added confidence and possibly prevent a cop from "accidentally" arresting you for breaking a law that doesnt exist.
