It's not bullshit you CAN'T shoot someone unless they are threatening your life. The link didn't work but I think I know what incident you are talking about. The drug smuggler who was unarmed got shot in the back as he tried to escape. The agents said he had an object in his hand that resembled a gun but it was never found. As much as I hate to admit it they didn't have the right to use lethal force. That is assuming that we are talking about the same incident.

From what I heard the BP officers shot the smuggler in the butt while he was running back across, yes, the smuggler tried to run the agents over which can be said the vehicle has been used as a lethal weapon, BUT, they shot him while he was running, that's just it. He wasn't carrying a weapon, he used the vehicle as one but he had his back turned towards the agents.
