It's real in the sense that you can play it and stuff, but it's not "real" in the sense that you could buy it on an NES cart back in the day. It's an extensive hack of the original SMB3, with tons of stuff changed, and all new level design.

Hmm, could be. My guess is that the hacker is using the "lives" counter/variable/etc to hold something else... maybe those mysterious "blue coins"? But no matter why he's doing it, you're right -- save states mean that no life counter is just fine.
