  • I was arrested at one of these points, I thought the guy waved me through, he arrested me and as I was on vacation from Canada and my passport was not in the car I was arrested, my car was impounded and I spent the rest of my two week vacation getting myself out of my hole.

    The oath I took used the words "all lawful orders".

    I refused to follow an unlawful order at least once while I was in the military. My superiors threatened me with an Article 15 (non-judicial punishment), but quickly backpedaled and dropped the incident when it became clear the I would not accept the their threats.

    I aced my next evaluation was early promoted shortly later.

  • It's too late at this point, but you should have filed a complaint with the CBP and OIG, reserving your rights to sue in the complaint. You also could have consulted with an attorney re filing suit on unlawful detainment.

    You are correct: there was no reason to suspect that you were anything but a lawful resident of the US. You were speaking English, in a car with other people speaking English, with domestic registration and plates. There is a decent probability the detainment was unlawful.

  • the 100 mile rule only pertains to land border. BP could not set up a checkpoint in Baltimore for example, so it's a lot less than 70% of the population. Also, the 100 mile rule only pertains to checkpoints, not overall Patrol authority. Patrol authority extends only 25 miles in (yes, this includes coastal), except in AZ, where it's 75 miles in certain parts.

If you are threatened with arrest and respond with "if you have that right and choose to do so I will not resist" or "I demand to see a commander or supervising officer" they probably will tell you to leave. The C.O. does not want to get involved when he knows that you are willing to go the distance.

  • Police officers and Border patrol are two completely different things. Probable cause does not apply towards matters of national security. Just becasue your a Marine doest mean you know shit about Law. Also for those of you who wish to argue about showing ID when pulled over. If you have a registered drivers license to get it you also signed a waiver stating you will show ID whenever asked by an officer, and submit to a sobriety test whenever asked.

I do not recall the watchdog guys that go to these checkpoints with video, never rolling down their windows, never being asked to pull aside. It is not "Fourth Amendment for Dummies", but reading it for a few hours will help you understand your actual rights, as enforced by the courts. Fortunately, your rights are more-or-less the same as a careful reading of the Fourth Amendment would indicate.

  • I've said it many times before this. Most people don't even know the 4th Amendment in its entirety, which is why the behave like this at checkpoints. There are necessary exceptions in the 4th Amendment that allow warrant-less searches and seizures such as those at checkpoints. Until you read the ENTIRE 4th Amendment, then it's rather pointless for you to comment on anything related to BP activity.

  • I say again, you apparently have not read the ENTIRE 4th Amendment which makes your view legally incorrect. First of all the key word in what you posted is UNREASONABLE. The Supreme Court determines what is unreasonable, and sets guidelines for government to follow. Again, research the EXCEPTIONS to the 4th Amendment which translate into what is reasonable for the government to act on statutory authority.

  • Really? Before I knew my rights, I let my property be searched three times. The third time they cut open and broke some of my stuff. I guess that was part of the deal.

    The odd part is, I never decided to learn my rights until I was arrested for a DUI, in which the officer didn't search anything at all. In fact, it was the nicest run-in with authority I've ever had.

    "Hey, You want to do some field sobriety tests?"

  • Thanks for not only posting these videos but for standing up for our rights as citizens. I'm a 60 y.o. white chick living in a retirement community 45 mi. north of the border and we are subjected daily to one of these "border" checkpoints. There are so many issues here (not the least of which is financial. Ours is "temporary" but the Border Patrol is planning to build a multi-million dollar permanent building - in an area that doesn't have money for schools, teachers getting laid off, etc.)

I truly believe you didn't feel your freedom was in jeopardy by having to briefly consent the fact that you're an American Citizen to a certified Border Patrol Agent. Look you have your beliefs and I have mine and I respect that, but in my opinion once again, I have seen these checkpoints work. I have read and heard where these men/women loose their lives because of their jobs. I don't believe in the Gulf War, but that doesn't mean that I don't stand behind the men and women fighting for my rights/freedom.
