You can't patent software any more than you can patent a novel, a song, a mathematical equation, or a recipe for a cake.
The US patent system is broken and the subject of widespread abuse by corporations that did not invent anything but simply buy frivolous software patents in order to stifle innovation and genuine competition.

What about investors who cannot get even started because of too many patents (a maze)? Patents can ruin innovation, too.
