    I don't imagine that poor telemarketer feels any better about YOU making false accusations... except my accusations are REAL!

    let me know which region you did this in and i'll pull the local penal code and explain which ones you likely violated, in my opinion and break it down for you. i might even make a video out of it for you... so you can feel the shame you tried to put on this poor, unwitting man.

  • @usenetposts regardless of what I do for a living (I'm working on my undergrad in psychology and pursuant of an MD [likely going to be a general practitioner]). I may become an EMT in the interim and become ACE certified to be a personal trainer. I like helping people... even if you don't like it. if you don't like this person calling, you are MORE than welcomed to hang up.

  • @AssistingHealth I already had done that several times before. This was the time to get even. I am usually more friendly and helpful than most to telesales people, for the record, but this company and this guy was utterly obnoxious.

I even recommended you to someone recently because of how entertaining you make the learning process (wonderful oratory and pedagogical skill... rather scarce in most institutions, if I might say).

    your teaching is a hot commodity... not your brow-beating of a telemarketer.

  • @usenetposts my main point here is to be a gentleman and politely decline and hang up the phone versus trying to belittle another for doing their job (times can be tough... that person may even be in the middle of getting another job, just hasn't been hired yet... you just don't know) and proclaiming illegal activity (likely a false allegation) which in iteself, may be illegal.

  • @AssistingHealth I'll tell you this, if every financial person conducted themselves like me there'd be no such thing as insider trading. And I was not polite to him because he was not polite to me. I am usually fairly cordial to telesales people if they don't come across like this heavy-duty guy. There is a way to do telesales and there is a way not to do it. And since this company seems to have gone the journey I'd say the market has shown them that wasn't the way to do it.

  • @AssistingHealth I don't think you know the meaning of the word ousted, along with several other words you've used in this exchange. My suggestion is if you want to know whether I am mistaken or not, at least look at the definition of insider trading - even the one which appears on wikipedia. You'll see it hinges on handling unpublished info. I *asked* him if he was going to give me unpublished info over the phone about this company traded on NASDAQ and he couldn't deny it.

  • @AssistingHealth Only a judge can decide if a crime is committed, of course, but I am saying that if he is passing to me unpublished information so that I can trade in it, then you tell me what country's insider dealing law that wouldn't be in breach of. It is illegal and unethical for me, as a professional accountant, to take and act on unpublished tips about a stock. If he is trying to give me "insider" tips on a stock, he is trying to make me break the law.

  • @AssistingHealth That's too made. I have answered your question. If you want legal advice, go ahead and get it. Legal advice is not my hobby, I don't hand it out free like linguistic advice. If a person is unable to tell me whether they are giving me unpublished info over the telephone for me to deal with or not, then they put me in a difficult position vis a vis the law.

  • @usenetposts @Assisting Health UK accountants have been jailed for conspiracy to insider deal and extradited to the US on little more than going along with things like this. It is absolutely right for me to say what I have said when faced with this approach, and if people don't want to be put on YT it is very easy - don't spam-call me. If you feel sorry for the person here, then fine. You be nice to him when he calls you and inveigles you into ethically dubious propositions.

  • @AssistingHealth It's at the heart of insider dealing law that people don't trade on inside information, so if he says that he has unpublished tips that he wants me to look at, how can I tell that he is not passing on unpublished info so that I can trade in it. The way that he approached me sounds like he wanted to be an accessory to unfair trading.

  • @usenetposts oh no, i don't suggest you listen to them. often it's a small-caps investor attempting to pump-and-dump a stock(perfectly legal). which part purported to be insider information? infact, it seems as though the act of cold-calling to inform people is what MAKES said information public. usually insider trading is done in a more clandestine fashion... which this obviously is not. which bit of jurisprudence or statute/ordinance/et al do they seem to you to be breaking? i could be wrong.

  • @TheAmericanOriginal The company was in Korea, so I expect that some of them are Korean. They use American accents so that other English speaking foreigners think they have an American on the line, but it could be anyone.

  • Whenever I get a call from a telemarketer I like to toy with them and talk to them in a made up language or something... sometimes it confuses them so much lol I don't even have to hang up they do that within the first couple of seconds after repeating what they sid the first time... then I never hear from them again lol and if I do I just do it all again lol I act like an idiot and they leave me alone lol although its granted I'm not an idiot lol

  • Yes they just called me as well. (May 20th-2008) The persons name was Michael Morris and was very slick. Same tone and same words. I really don't like the way he treated my staff to get to me (Very pushy and disrespectful)

  • I had Alvin Man this morning (3rd March), I cannot be sure that it was the same guy, but my assailant used the SAME tone, the SAME words, and the SAME company!! Ticker MPDD. He offered me a 10K shares at $3,35 due to hit $5,25 within 90 days. Then 5K with a fee of $150 (but how much for selling??). He even assured me he had sold these shares to his father-in-law so he must be sincere (!) Value is $3.60 today, so after the style you will be able to judge the result.

  • For those that do not know, the scam works like this. Stocks are bought at a low price. Then the scammers move in and say the price will move (which of course it will if there is sufficient interest). They get out.

    Jeffrey Archer's novel Not a Penny Less, written around thirty years ago or so, gives a good account of a more sophisticated, but similar, scam.

I usually get so mad I can't say exactly what I want to say to people on the telephone. Person to person I am calm, but there is something about people on the telephone that drives me up the wall. I usually hang up without saying anything.

  • Berkshire Hathaway seems to have a balanced portfolio, including stocks which they think are undervalued. Nevertheless, its value really is a function of the flow of money in the market and not of the earnings potential of the shares they hold. It could be a good time to sell this share, and then use the money in a few months to grab some bargains in the property market from the foreclosure of subprime mortgages. But I'm not taking legal responsibility for advice.
