  • Both Jay Carney and Obama know that what they did was unconstitutional and a crime. If they had evidence that he was involved in any of these things then they would have no problem in showing the public the evidence. They never even charged Awlaki with any crimes. Obama was a constitutional law professor. He knows what he did was not right.

  • The executive's assumed right to execute an American citizen without judicial review and due process is a huge step backwards in the rights of man. This type of political philosophy predates both our constitution and the Magna Carta and almost all enlightenment philosophy on which our founding fathers relied when establishing the raison d'etre of this government. This case is the largest development in assumed government powers vs. the rights of citizens in the history of this country.

The office of president has always come with a lot of power, the scope of which has definitely grown over the course of our history and which, tellingly, has always included the right to pardon a convicted criminal. That power never explicitly included the ability to order an assassination.

  • I'm as liberal as they come, and I've always had a problem with this administration targeting a U.S. citizen (Awlaki) for assassination. However, at the same time, it's a bit of a gray area. If you know where the guy is and you know he's literally preached death to America and helped people to commit acts of terrorism, then do you risk the life of service members to capture him for trial, or just take him out? Is an innocent's life worth bringing him to trial?

  • @shalcall In consideration that he was in fact an American... yes, they should have attempted to arrest him. I served in the military and I joined understanding such risks were part of that sacrifice. If I take an oath to support and defend the Constitution and further take upon the role of protecting the rights of Americans.. I have a duty to even protect the rights of this man.

    By doing such, it would have sent a far more just and morale message to the world. It's a real shame.

  • @brettdusek So, if I had to choose between having Awlaki assassinated or risking my own life to bring him in, I would always choose the latter.. for as a soldier, I am bound to nothing more superior than to my oath. Not even the Commander-In-Chief is more superior.

I was a Marine and if Awlaki was on a battlefield with his birth certificate and passport stapled to his chest, if he had a gun, he'd still be shot and killed. If he was a messenger, he'd still be shot and killed. If he was a hostage, being used as a body shield on an active battle field, he'd still be shot and killed. So if you sent the military in to pull him out, he could still be shot and killed (like Osama). Why risk it?

  • @shalcall I agree with you. However, the fact is he wasn't on the battlefield and he didn't have a gun. He was driving in a vehicle with what appears to be another American, when he was attacked by a drone.

    Yes, by sending in the military to make an arrest, he very well might have still been shot and killed if he resisted. However, in that instance it would have been just, for the threat would have then been imminent.

    It's cowardice how we went about it.

  • @patrickcorliss Look, I've said repeatedly that I'm uncomfortable with this entire exercise, and if the Reuter's report is accurate, I'm very much against this action and congress should use its oversight role to really delve into this matter. However, the PRINCIPLE of executing U.S. citizens abroad who are actively planning to kill American citizens is not something that I think is a black and white issue. I think it's something that should have a check (congress or the courts).

  • @shalcall, How would you explain the administration's refusal to provide the evidence they supposedly have of his guilt? Your hypothetical starts, "if you know...". Well, if they actually knew he was a terrorist, they should be able to produce the evidence on the basis of which they knew it. If they don't have any evidence, then they didn't know any such thing.

  • @owl235 You're right that they need to make the case. But I've seen Awlaki's videos (and the FBI is probably watching me because of it, lol). Now yelling fire in a crowded theater is not protected speech, so I'm guessing telling terrorists that it's right and proper to kill Americans from Yemen while associating with other terrorists is probably not protected speech either, but I don't know if the Supreme Court has ruled on that.

    But that idea of risking lives to arrest him bothers me.

  • @cooljj82 Actually if you pay a hit man to murder your wife, that's murder 1 even though you weren't the one to pull the trigger. But yeah, to me, his location is a huge deal. Being within the U.S. border is very different than being outside the U.S. border. So global location really does make a difference. Again, I still think the administration has a responsibility to make the case WHY this man was killed and provide that evidence to the public. But the action itself is a gray area for me

    The issue isn't whether or not he "helped people to commit acts of terrorism," but rather whether the U.S. President can kill U.S. citizens arbitrarily. If proof of Anwar al-Awlaki's guilt exists, why isn't it being presented?

    There's nothing "gray" about it. It's black or white. Either they present evidence or they don't.

  • @carlwk3c I think it's a gray area. The constitution does not say that it is restricted to U.S. citizens. It's laws are applicable (or supposed to be applicable) to ANYONE under U.S. jurisdiction. Yemen isn't in U.S. jurisdiction. Look, I agree, the man should have been tried (even if it was in abstentia). But if you're not on U.S. soil, even if you're a U.S. citizen, can you really say that the constitution protects you?

If a US citizen goes on vacation to france can the FBI raid their home? Can the CIA assasinate them on a cruise off of the gulf coast if its far enough out? Lets not go down that path. Does that mean the U.S. is prevented from participating in wars due to the 5th amendment? I don't think you'd find a judge that would agree with that. So then you begin laying out the case that war is different and in those semantics you'll have to ask if we're at war with Al-qaeda, if Awlaki is part of al-qaeda etc., etc.

    The White House spokesman was dumbfounded that someone dared to question the official story, and obviously had no answer as to what this "terrorist" actually did. It was a little Freudian the way he even stumbled over the word "terrorist" in the middle of the video, like he couldn't honestly say he was one.
