I just got out in July and I was an MP. Each post/fort has individual agreement with counties. Like at Fort Campbell where I was stationed in Kentucky. Christian County jail housed a lot of Soldiers that were awaiting trials. Being situated at a County Jail falls back on the BN CDR. A simple phone call to the PMO asking where he can place Soldiers until their trial for whatever they are in violation of, they will simply refer them to a county jail.
i was shocked when i heard that the military was disarming the people in N O after the storm Katrina, taking away their right to defend and protect themselves. even blown away when the first news of returning war veterans being classed as terrorist. now everybody that believes in the constitution is a terrorist. is this America or some nightmare from WW2. the war on terror is like the war on drugs, it's made up to take from the people. there's money to be made in any kind of war.

Followup to the below, in reference to the military not involving itself in controlling civilians. Also note, quite the contrary, the military NOT supposed to involve itself in civilian affairs concerning whatever actions the public takes against them, but rather the military "should" and "supposed" to guarantee the rights of the American civilians to do so, even to the point of helping the civilians if the government goes so far and tries to use the military on civilians.
It would be inappropriate to give any condemning info concerning the soldier and unit. Are you people so shallow you want to make things worse for the soldier? Or, are you plants trying to run down leads? They do exist in many forums/sites. All I can add is, everyone should explain to their chillins that it is not right for the military to be used against their own civilians. That is the job of the police. Also if it is the will of the people they can do whatever they wish with the government.

Not all soldiers will get this test, but it is a random poll of soldiers the DoD issues for their use. This test originally was given at 25 Psalms, CA.

I have just posted the oaths you must swear by to enlist. The main phrase is "foreign and domestic." No matter what your personal beliefs, you, as a soldier, you have affirmed this upon enlisting. Not doing so is a violation of you oath, and a violation of the uniform code that has been in place for more than 50 years.

This makes no sense. The county sheriff does not hold soldiers awaiting court marshal, they are held by the nearest military facility that has confinement facilities.

@mjeffcoat1 Actually, military regularly uses civilian detainment facilities. Civilian jails are regularly used for breaches of UCMJ. In addition to separating unit members and eliminating risk of sympathy by other soldiers, the advantage is containment without criminal charges.
This is typical for anyone who bucks the system or is a threat to organization. It was SOP at both Ft Gordon and Ft Benning.

Not true in the Guard. The unit issues an apprehension warrant for the member and then LE picks him up, and transports him to the jail to await pickup by his unit or MP's.

Not too sure how true this is. This "email letter" has been floating around for over a year now, but there is NO other supporting evidence anywhere, NO copy of National Guard questionnaire, NO other posts/letters from any other National Guard members stating they took a questionnaire like this.
So, based on those facts, I would call this a hoax.
If this is true... people who know need to name names, name units and reveal all information.... so citizens can work with pertinent facts to support this victim. I'm more than willing to believe this story... if enough facts are provided... so far... this not the case.

If you google this story you'll find that the soldier was released after two hours, and the officers responsible are under investigation.
I'd rather they were open about what happened and the mistakes made, but it seems inappropriate to use this incident as evidence that the US is becoming a police state. I just got out in July and I was an MP. Each post/fort has individual agreement with counties. Like at Fort Campbell where I was stationed in Kentucky. Christian County jail housed a lot of Soldiers that were awaiting trials. Being situated at a County Jail falls back on the BN CDR. A simple phone call to the PMO asking where he can place Soldiers until their trial for whatever they are in violation of, they will simply refer them to a county jail.

Or, are you plants trying to run down leads? They do exist in many forums/sites. Not all soldiers will get this test, but it is a random poll of soldiers the DoD issues for their use. This test originally was given at 25 Psalms, CA.

I have just posted the oaths you must swear by to enlist. The main phrase is "foreign and domestic." No matter what your personal beliefs, you, as a soldier, you have affirmed this upon enlisting. @mjeffcoat1 Actually, military regularly uses civilian detainment facilities. Civilian jails are regularly used for breaches of UCMJ. In addition to separating unit members and eliminating risk of sympathy by other soldiers, the advantage is containment without criminal charges.
This is typical for anyone who bucks the system or is a threat to organization. It was SOP at both Ft Gordon and Ft Benning.

Not true in the Guard. The unit issues an apprehension warrant for the member and then LE picks him up, and transports him to the jail to await pickup by his unit or MP's.

Not too sure how true this is. This "email letter" has been floating around for over a year now, but there is NO other supporting evidence anywhere, NO copy of National Guard questionnaire, NO other posts/letters from any other National Guard members stating they took a questionnaire like this.
So, based on those facts, I would call this a hoax.

I commanded Charlie Company, 3/156th Infantry, LARNG, in Jennings, LA. We had riot gear. We had bean bags to shoot from our grenade launchers, rubber bullets and we had lethal force as well. It is part of the mission, not news. Refusing the poll, the specialist put his weapon on the deck, making his choice a much larger issue. Taking the poll, he could have discussed his answers w/command. Instead he incited discord. Command overreacted; but, the man disobeyed a lawful order.

America is free because of people like us-breathing life into paper documents. Violating is a far cry from domestic enemy. To declare someone while denying them right to trial is exactly why those documents exist.
You're right UCMJ violations are not the same. UCMJ holds us to a uniform standard.

Why did you serve in Afghanistan? The delegated purpose of the military is to repel invasions and quell insurrections. Nowhere does it state we are the world's police force. That requires a constitutional amendment.

That is a direct violation of your oath regardless of who gives the order. My dad served in WW2 and Korea. He said it wasn't uncommon for officers to get shot by friendly fire. The oath reads " to support and defend the constitution of the United States against all enemies, foreign and domestic..." A purpose of our National Guard is to control crowd threats. If you google this story you'll find that the soldier was released after two hours, and the officers responsible are under investigation.
I'd rather they were open about what happened and the mistakes made, but it seems inappropriate to use this incident as evidence that the US is becoming a police state. It's like saying McDonalds hates the environment not because of their industrial practices, but because you saw the manager of one particular restaurant drop a cigarette butt in the street.
