Orochimaru isn't exactly dead, it's more like he's permanently trapped in a genjutsu (in some alternate dimension, or something) caused by that sword Itachi used (I forget it's name)until he dies.

orochimaru attempted the body switch but sasuke suppressed him so now he has orochimaru's power but once he's too weak orochimaru comes out.

when itachi was abt to die so he saw the danger and although he is mean to sasuke, he really loves him and actually he was ordered to kill sasuke but couldnt get himself to do it so he ordered konoha to take care of sasuke.

itachi removed the seal and put oroc in a dream-like realm.
