Army Regulation states if he is ACTIVE DUTY IN UNIFORM he would be in violation, but if he is a U.S. ARMY RESERVIST on IDT orders than he is considered an INACTIVE DUTY TRAINING STATUS and the ACTIVE DUTY ARMY REGULATIONS DOES NOT APPLY.

I do not understand why military/authority treat a human like a trash. If they have fear and discrimination based training system in the military, they should stop it immediately since it will never bring a peace and they will never solve any problems. I've never heard a good explanation on how traveling to another continent to battle poor people which barely can place USA on a map, is to defend ones own country. I'm Canadian an I look at your country in disbelief, my country has it's issues as well ie the G8 an G20 summits where Toronto was transformed into a police state violating everything Canada stands for, us Canadians had it easy and it was a shock to see police cruisers being burned in the downtown core. I dont think that the number of regs in the UCMJ handbook is a good excuse. When I joined I had the uniform rules among many others pounded into my head so I think Cpl. Thorsen should have known that what he was doing was against the rules. Breaking it doesnt mean hes a bad person it simply means he made a choice and nothing more. I agree with Cpl. Thorsen but he should have thought to change out of his uniform before he went to the rally.

@zerocool155 Military people are allowed to have opinions - just not in public in uniform. The rule is there for a reason - to avoid insubordination, etc. The military is not a democracy. If we just picked and chose what rules we wanted to follow, even in society, where would that lead? To chaos. We have the right to free speech - I don't agree with everything the administration does - this one or the past - but I don't go to a political rally in uniform, get on TV and blast it.

Why aren't people even asking what the hell we are doing in Afghanistan anymore and why Obama "surged" there in 2009? I grew up in a country that spent 9 years, 1 month and 21 days there with weekly updates of how good it was to extend our "international debt" to Afghans - we were all dodging the draft to the best of our ability. Now my country is outlasting this with no end in sigh and no "victory" possible: it is insane.
@everythingelse2010 We're starting a drawdown and supposed to be out by 2014. He "surged" in 2009 because the situation started to deteriorate like Iraq and so he stole that from the playbook. Congress has the authority to approve military action - they did. All the Constitution says is that Congress has the authority to declare war. It doesn't say how or what format. It doesn't say formally say "war." They have the authority to engage military action. Iraq and Afghanistan are military engagements and Congress - approve - both. Next.
The National Defense Authorization Act is putting the power of despots and dictators into the hands of unknown future bureaucrats. People and their candidates supporting this moral hazard are out of their minds.

This does not even take into account the storage and maintainence req'd with hyrdogen. I dont think that the number of regs in the UCMJ handbook is a good excuse. When I joined I had the uniform rules among many others pounded into my head so I think Cpl. Thorsen should have known that what he was doing was against the rules. Breaking it doesnt mean hes a bad person it simply means he made a choice and nothing more. I agree with Cpl. Thorsen but he should have thought to change out of his uniform before he went to the rally.

I grew up in a country that spent 9 years, 1 month and 21 days there with weekly updates of how good it was to extend our "international debt" to Afghans - we were all dodging the draft to the best of our ability. Here's a thought... let all the relatives of all the soldiers who have died or been injured in ALL the wars that have not been declared by the congress sue the government for their loss, if not for any other reason than to send a strong message that the victims families are aware of the illegality of these wars.
I'm no lawyer, but simple logic dictates that if the wars are not declared by congress - THEY ARE ILLEGAL!

@BAZCATS Military personnel cannot sue the government or their chain of command (Feres Doctrine). Iraq and Afghanistan wars are not "illegal." Congress has the authority to approve military action - they did. All the Constitution says is that Congress has the authority to declare war. It doesn't say how or what format. It doesn't say formally say "war." They have the authority to engage military action. Iraq and Afghanistan are military engagements and Congress - approve - both. Next.
