I think these copyright laws have turned to shit. I can't even watch the official Metallica music videos off Metallica TV because some stupid message comes up saying "This video is not available in your country because it contains content from UMG." and I get this same message on every website I go to just to see at least one official Metallica music video.
@MDXB001HACKZ Things have gotten better since this video was posted, but some countries still get the "fuck-you" treatment by the labels. Users in Germany can't post any music, as far as I know, and yes, every time I upload a video, I get a list of the countries it will be completely blocked in, and Australia is, a lot of the times, one of them. It's rarely the artist themselves who do this. In fact, I've never seen an artist complain about this, other than a few old geezers. It's ridiculous.

Metallica is heading down a path where they are losing their ability to "make good hit songs". The last album Death Magnetic may have been a good or an ok album, but unfortunately, the majority of the world cares about what's the latest hit single. Did Metallica make any? No. Therefore they are pressured to not screw up their record deal and try to make a second chance, they are putting their career before their fans and it's sad but true.

I would like to point out that for many decades now artists and bands have been publicly performing cover versions of records i.e. live at public venues. This doesn't seem to have ever been a problem for the record companies. And these people do it for monetary gain. I imagine that the record companies regarded it as free promotion for their products, and it would be impossible to police.

Yes, everyone who had a WMG song i their video got either removed or muted. Even acoustic covers or collaborations thanks to YouTube's automated video identification system. We're campaigning for the respect of Fair Use.

Yes, many WMG artists got their stuff taken down by WMG, many without even a warning. However, Metallica was the only one encouraging their fans to do covers in YouTube. Not because they're cool, but to promote Death Magnetic. When the fans' covers started to disappear, Metallica did nothing. Not even a video saying sorry, or explaining what was going on.
Great video. The funny thing is that this has happened to me. TWICE. Same label. Warner took down my Muse "Hysteria" and RHCP "Around the World" cover videos on the same generic, vague grounds. But, I submitted my disputes and they're back up. So if you all dispute it, you might get them back too.

I don't listen to their artists, I don't buy their stuff, I don't even download it illegally -- I completely boycot them.
Instead, I now seek out music under the Creative Commons or I search the web for unsigned bands. If I like their stuff and it is copyrighted, I shoot them an email asking for their permission.
So far, every single band has given me permission.
That's the best possible thing anyone can do: Just start listening to and using independent music.
Unfortunately, too many people refuse to believe there is music beyond the mainstream. Weaning people off of RIAA-produced corporate music is harder than keeping an actor in rehab.

The thing is, not everyone who plays cover songs on youtube are musicians. May are people who like playing after coming home from their day jobs (even chefs, I've met here). Others are kids who are teaching themselves to play and cover videos from other people really helps them. I know I've learned quite a few songs from watching others play them.

I remember watching Lars's video, and thinking that it looked so contrived, and when he said "YouTube world" and "our stuff" there seems to be a gleem of discontent in his voice and face. I believe from the beginning that, as you point out, their promotion of our videos was simply to help market their new album, and ultimately the truth would come out.

How can artist's or rather their label dispute FREE promotion. I think "covers" make a band more noticeable. I think this is a bad move on their part in the long run. I can understand if youtube covers caused an income that they did not get a cut of...no money is exchanged here. Therefore, I don't see the ***infringement*** usually this crap has to do with money so I think this is just somebody being an asshole because they can.
Copyright law used to be a good thing. It would protect you as an artist from other people playing your song and saying they created it. But this has changed over the years. Big corporations have started seeing Copyright law as a doorway to get money. That's all they think about, how to profit more. So much that they've stopped caring if the profit they're making is negatively affecting others, or even if it's legal. It's the law that should change, cause they'll never do that.
This is all such bulls**t. Just put a stupid advertisment in front of everyone's video, make it so you have to watch the ad before you watch the video. Charge the company who wants to advertise, give Warner a cut so they can STFU - Youtube takes the rest and uses it to pay for the bandwidth we are all using and call it a day - problem solved. The problem I see here is the record companies are doing their best to keep CD's on the market, since they price it quite high. The problem with CD's is they stopped offering the "art form" of music. Sure, they have songs in them, but that's it. LP's on the other hand offered an art piece with each buy. Now they just slap on a picture of Britney Spears on them and expect to sell it at over 20 USD. They're doing this for money. Period.

It would be me drumming to a song...but ONLY the drums. No back track. I think people might enjoy it. Granted, it would be boring for the average viewer to watch...but if someone wanted a drum track to play the guitar along to, it would work well. It might also help people create their own collaboration videos with it!

I haven't heard of them removing songs which don't include a backing track. If they did that to one of mine, then I would be pissed and put up a fight. But since we're technically using their intellectual property by including the original song in our videos, we have no legal claim if they want to remove our videos, except fair use, and that hasn't worked out very well. So there isn't much of a fight we can put up, unfortunately.
I think I've heard of a few people getting their covers removed because they were playing a Warner artist song in a band video. I don't have solid evidence on that yet, though.
Nevermind my last reply. They ARE removing videos without a backing track. One of their most high-profile victims: the guy who did the John Williams tribute a capella video, Corey Vidal, or ApprenticeA.

AMV's should be allowed as well. It's user-generated content. They're done without any revenue and they don't hurt anybody expressing political ideals. The record companies want to control everything their music is used for. Even BACKGROUND MUSIC! like, if you post a video of a party in which the song is copyrighted, they'll remove it. Part2. And there isn't an actual product being produced. People hear the song and walk away with a memory of it. YouTube is different, it provides a product. I believe the record companies are very nervous about what the internet means for their industry. I don't have any sympathy for them. The music industry has always been able to count it's profits in the billions of dollars. Very little of that has ever flowed down to musicians. I say if you don't make money out of it - tribute is not theft!

Pook you're absolutely right when you say the reason they're doing this is because they can! I would like to point out that for many decades now artists and bands have been publicly performing cover versions of records i.e. live at public venues. This doesn't seem to have ever been a problem for the record companies. And these people do it for monetary gain. I imagine that the record companies regarded it as free promotion for their products, and it would be impossible to police.

It is sad that it has to be that way, but you cover bands mostly play the music better than they do anyway. I put a protest WMG/Metallica video up and posted it as a Video Response. Good luck and I agree with what you are saying. Good luck with the battle. We as video makers putting songs in the BACKGROUND are pretty pissed as well.

Yes, everyone who had a WMG song i their video got either removed or muted. Even acoustic covers or collaborations thanks to YouTube's automated video identification system. We're campaigning for the respect of Fair Use.

Yes, many WMG artists got their stuff taken down by WMG, many without even a warning. However, Metallica was the only one encouraging their fans to do covers in YouTube. Not because they're cool, but to promote Death Magnetic. When the fans' covers started to disappear, Metallica did nothing. Not even a video saying sorry, or explaining what was going on.
Metallica really doesn't deserve such loyal fans.

Great video. The funny thing is that this has happened to me. TWICE. Same label. Warner took down my Muse "Hysteria" and RHCP "Around the World" cover videos on the same generic, vague grounds. But, I submitted my disputes and they're back up. So if you all dispute it, you might get them back too.
Metallica is at the mercy of their label. Just like all bands. Not sure what Bizkit's situation was. I know Metallica loves watching us play their stuff. If their label threatens, they have to obey.

Great video ... The way I fight back is no pay no more tributes to any of their artists (I drum along various music).
I don't listen to their artists, I don't buy their stuff, I don't even download it illegally -- I completely boycot them.
Instead, I now seek out music under the Creative Commons or I search the web for unsigned bands. If I like their stuff and it is copyrighted, I shoot them an email asking for their permission.
So far, every single band has given me permission.

Unfortunately, too many people refuse to believe there is music beyond the mainstream. Weaning people off of RIAA-produced corporate music is harder than keeping an actor in rehab.

Hey, thank you for the feedback. You make a very good point here. However, for me personally, my goal is to drum along with music that I like. If I can't use the major artists, then I can still do what I love to do.
For people who are not in it for the fame, this solution works great. I am like a jazz band, I do what I love and 3 people are watching me :)

The thing is, not everyone who plays cover songs on youtube are musicians. May are people who like playing after coming home from their day jobs (even chefs, I've met here). Others are kids who are teaching themselves to play and cover videos from other people really helps them. I know I've learned quite a few songs from watching others play them.
They want to monetize from every single aspect of the consumers lives, but in this case, its an invasion of privacy.

Yes, it is a great thing for learning and that's fair use in my book. BUT, I am not the judge.
They want to make money -- we all do. I think the copyright laws themselves are fairly reasonable, though some portions might need a few modifications.
The REAL problem seems to be what you mention here, namely that they are working hard to control the WHOLE thing and get ALL the money. There should be laws against such monopoly -- I mean Microsoft was a big problem in that respect not long ago.

Sadly, it's not YouTube whos doing this. It's Warner. They think they have the right to control what we do with the CD's we buy.... IN OUR OWN HOMES! YouTube is a pussy for not standing up to this, but it's Warner who's basically telling us how to live. They're basically saying: "If you buy an album, just LISTEN TO IT! Don't let me catch you doing anything else with it, like playing along to a song!" It's nuts, and it's a violation of our consumer's rights.

part 2.. in addtion, I remember posting a comment to our friend Louddrummer when his Sandman video was highlighted by Metallica's site. I foresaw what was coming. The whole thing reminds me of Mao Tse-Tung's "Hundred Flowers Campaign" wherein Mao invited those critical of the Chinese government to come forward and share their ideas. Then, after a few months, Mao's government started to prosecute the same people! Lars hasn't changed since the Napster controversy.. .he's part of this mess.

I remember watching Lars's video, and thinking that it looked so contrived, and when he said "YouTube world" and "our stuff" there seems to be a gleem of discontent in his voice and face. I believe from the beginning that, as you point out, their promotion of our videos was simply to help market their new album, and ultimately the truth would come out.

How can artist's or rather their label dispute FREE promotion. I think "covers" make a band more noticeable. I think this is a bad move on their part in the long run. I can understand if youtube covers caused an income that they did not get a cut of...no money is exchanged here. Therefore, I don't see the ***infringement*** usually this crap has to do with money so I think this is just somebody being an asshole because they can.

Copyright law used to be a good thing. It would protect you as an artist from other people playing your song and saying they created it. But this has changed over the years. Big corporations have started seeing Copyright law as a doorway to get money. That's all they think about, how to profit more. So much that they've stopped caring if the profit they're making is negatively affecting others, or even if it's legal. It's the law that should change, cause they'll never do that.

Thanks man. I got the "tribute is not theft" idea from a video I saw of a guy explaining why posting music not belonging to you on youtube "is theft." He then proceeded to counter each statement like "Im not making any money out of it" with the phrase "theft is theft."
Since when declaring yourself a fan of an artist and paying tribute to them is theft?! Warner is looking for money where there's no money to be earned. They've lost touch with reality.

Until Warner have stopped stressing out about an unfounded threat to their revenue, I will not be buying any of their albums. The problem I see here is the record companies are doing their best to keep CD's on the market, since they price it quite high. The problem with CD's is they stopped offering the "art form" of music. Sure, they have songs in them, but that's it. LP's on the other hand offered an art piece with each buy. Now they just slap on a picture of Britney Spears on them and expect to sell it at over 20 USD. They're doing this for money. Period.

They just shut down completely a video of me and a friend on guitars playing "Big Boss Man" which is so old as to be a classic Jimmy Reed song and they accompanied that with a threat saying in effect " If you do it again we'll shut down your whole site." So I'm renaming every cover I do which only amount to about 10 songs.... out of 65. Thinking of moving over to facebook.

It would be me drumming to a song...but ONLY the drums. No back track. I think people might enjoy it. Granted, it would be boring for the average viewer to watch...but if someone wanted a drum track to play the guitar along to, it would work well. It might also help people create their own collaboration videos with it!

I haven't heard of them removing songs which don't include a backing track. If they did that to one of mine, then I would be pissed and put up a fight. But since we're technically using their intellectual property by including the original song in our videos, we have no legal claim if they want to remove our videos, except fair use, and that hasn't worked out very well. So there isn't much of a fight we can put up, unfortunately.

Youtube's "audio swap" has a list of songs you can use in the site without worrying about copyright infringement... check out the list... now THAT's lame!

AMV's should be allowed as well. It's user-generated content. They're done without any revenue and they don't hurt anybody expressing political ideals. The record companies want to control everything their music is used for. Even BACKGROUND MUSIC! like, if you post a video of a party in which the song is copyrighted, they'll remove it. This got to stop!

I know :) Actually I think they're removing those too. Linkin Park is a Warner artist, and we all know how many AMV's use Linkin Park tunes... I know this thanks to ThatDudeInTheSuede :).
