@gentlepat2k, The term, "native-born", simply means that one was born within a particular region. All persons born within a certain region can not claim that they belong to the native population; (ie, Obama is not a "native Hawaiian"), nor can they claim to be "natural born citizens" if one or both their parents holds citizenship in a foreign region. You can't claim to be an Eskimo, just because you were born on Indian land in the Alaska.

The only instance where a(or both) parent's citizenship is an issue, is if the child is NOT born on U.S. soil. So, again, short of proving Obama was NOT born in Hawaii, there's nothing to discuss. Until or unless someone can prove that, there is no constitutional issue.

A dual citizen is not eligible because they were born holding foreign citizenship. Those born with dual citizenship have never been considered to be natural born Citizens. Obama himself has only claimed to be a native born citizen, born in Hawaii. He has never claimed he is eligible.

@scismgenie, Yes, that is an immigration law that was passed when John McCain was 11 months old, which made him "a citizen". The Constitution requires the President be "a natural born Citizen" not just "a citizen". A natural born Citizen, is one born within the United States to US citizen parents. Such a person would owe allegiance to no other nation. You are not considered "natural born", if become a citizen through the application of an immigration law.

Obama was not born on US Soil and his Mother was not a representative of the US Government, either State Department or Military, that would have given her child's acceptance as a US Citizen. Resolution 511 declaring John McCain a natural born citizen, because, he "was born to American citizens". In other words, no other nation on Earth can claim jurisdiction over you. @TFarache, That is not easy to answer. A question still remains about his true citizenship status. There is evidence to suggest that he was adopted by Lolo Soetoro and became a citizen of Indonesia in 1967. It is known that he traveled to Pakistan in the early 1980's, and it is believed that he traveled on an Indonesian passport, meaning that he, as an adult, renounced his US citizenship. Until we can see his records, we can't know for sure that he is a US citizen. He may be an illegal alien.
He is a natural born citizen because HIS mother is from Kansas. The last time I checked Kansas is in the United States. His father was on student visa.

@quemacha People need to take some lessons on law. When the child is adopted the child becomes a legal citizen because there is a legal process involved in adoption. Papers from the child home country have to be in order before that can be done. That is the reason why countries have immigration laws so that they can track ppl migrating to their country and so that there is no issue in citizenship.

We citizens of the USA are guaranteed by The Constitution, and those who support and defend it, to have a Natural Born Citizen President. @riffroof, Martin Van Buren was the first Natural Born Citizen President, and took office March 4, 1837. George Washington was not a natural born citizen, however he was a Citizen of the United States, at the time of the Adoption of the Constitution, and thus fully qualified and eligible to hold the Office of President. The Founding Fathers wanted our Presidents to be Natural Born Citizens so there would be no question of Loyalty to our nation. The one thing that Barry Soetoro clearly lacks.

Under the Articles of Confederation, there was no provision for US citizenship, only for citizenship in the member states. Like his predecessors, Mr. Van Buren did not become a naturalized US citizen until the US Constitution was ratified in 1788.

Martin Van Buren was born in Kinderhook, New York, on December 5, 1782, to two US Citizens. There's a whole generation of half-Vietnamese people who are my age who were born with dual citizenship because their serviceman dad was a US citizen and their mom was a Vietnamese citizen. My father was born the son of an Australian mother and a US father, and had dual citizenship for 18 years.

I've heard that the use of "Parents" in defining Natural Born Citizenship status is a collective noun. Meaning only one parent is necessary. I think it checks out and I'm signing off on the Birth Certificate issue.

ergo: Obama may have been entitled to Kenyan citizenship, but that entitlement was revoked when he reached the age of 21, being a US citizen through birth, residence and parentage.

It did not say the children of a US citizen(singular), but the children of US citizens(plural).
In 1795, the Naturalization Act of 1790 was replaced, and the clause "natural born" was removed, making all foreign born children of US citizen parents, only citizens. This left the United States as the only place in the world, where the children of US citizen could be born, and be considered "natural born". The children of foreign fathers, were never considered as citizens by the early immigration laws, even though they had US citizen mothers and were born here.
It is worth taking the time to read those first 2 immigration laws. They are very short, and easy to read. It is also worth noting, that when a foreigner wanted to become a citizen, they had to go through certain residence requirements and their character,( i.e. morals, work habits), was taken into consideration.
So what do you think will happen now? Will Obama be unseated as president? I think not. There might be another 1992 L.A. riot might occur or worse. Our constitution is being taking away from us and it does matter if he was a natural U.S. citizen. If it did not matter then what was the point of Obama raising his right hand and swearing under the oath of office? I am familiar with the law you speak of. It applies only to the ability of US citizens born abroad to pass their US citizenship to their foreign born children. My undersatnding (correct me if wrong) is that oh bomb duh's mom was born in the US (kansas), but I have seen no verification of that.

All persons born within a certain region can not claim that they belong to the native population; (ie, Obama is not a "native Hawaiian"), nor can they claim to be "natural born citizens" if one or both their parents holds citizenship in a foreign region. The only instance where a(or both) parent's citizenship is an issue, is if the child is NOT born on U.S. soil. So, again, short of proving Obama was NOT born in Hawaii, there's nothing to discuss. Until or unless someone can prove that, there is no constitutional issue.

The Constitution requires the President be "a natural born Citizen" not just "a citizen". A natural born Citizen, is one born within the United States to US citizen parents. Resolution 511 declaring John McCain a natural born citizen, because, he "was born to American citizens". Now if McCain is a natural born citizen because both of his parents were citizens, how can Obama be eligible, when it is common knowledge that his father was a British citizen? Why will they not apply the same rule to Obama?

In other words, no other nation on Earth can claim jurisdiction over you. That is not the case if you were born on foreign soil or if one or both of your parents were foreigners at the time of your birth.

There is evidence to suggest that he was adopted by Lolo Soetoro and became a citizen of Indonesia in 1967. It is known that he traveled to Pakistan in the early 1980's, and it is believed that he traveled on an Indonesian passport, meaning that he, as an adult, renounced his US citizenship. Until we can see his records, we can't know for sure that he is a US citizen. He may be an illegal alien.

@quemacha People need to take some lessons on law. When the child is adopted the child becomes a legal citizen because there is a legal process involved in adoption. Papers from the child home country have to be in order before that can be done. That is the reason why countries have immigration laws so that they can track ppl migrating to their country and so that there is no issue in citizenship.

It was only learned about 2 years ago that his father had not become a US citizen, until some years after Chester's birth. Then, as now, the "Birthers" were correct, but, the general population refused to hear the truth. Arthur strived to put an end to cronyism in the civil service. Soetoro does everything he can to destroy our nation.

Not that it matters, but George Washington was born in a British colony to parents who were both British Crown subjects, and he served with the British Army as a senior officer in the colonial militia between 1754 and 1758. In fact, by your criteria, the first US President who actually was a natural-born US citizen was John Tyler - and how fitting that he never was elected to the Presidential office.

@riffroof, Martin Van Buren was the first Natural Born Citizen President, and took office March 4, 1837. George Washington was not a natural born citizen, however he was a Citizen of the United States, at the time of the Adoption of the Constitution, and thus fully qualified and eligible to hold the Office of President. The Founding Fathers wanted our Presidents to be Natural Born Citizens so there would be no question of Loyalty to our nation. The one thing that Barry Soetoro clearly lacks.

@Bigone5555J, please correct me if I'm wrong, but I believe Martin Van Buren was born in the State of New York in 1782. Under the Articles of Confederation, there was no provision for US citizenship, only for citizenship in the member states. Like his predecessors, Mr. Van Buren did not become a naturalized US citizen until the US Constitution was ratified in 1788.

@riffroof, As of the end of the Revolution all free persons in the US became US Citizens thus Van Buren's parents became US Citizens, no longer British subjects in April 1782. Martin Van Buren was born in Kinderhook, New York, on December 5, 1782, to two US Citizens. The Articles of Confederation stated, "the free inhabitants of each of these States, ....., shall be entitled to all privileges and immunities of free citizens in the several States;" There was no need for him to be naturalized.

@ChapinCapitan, Despite popular belief, McCain was born in the city of Colon, Panama-not on a military base. Even if he were born on a military base, state department guidelines do not consider military bases US territory when it comes to citizenship. Being born in Panama, an immigration law was passed when he was 11 months old, making him a US citizen. So he certainly is not a natural born citizen, and is not legally eligible to be President.

It doesn't matter if Obama was born in Hawaii or not. His father was a foreigner. Children, at the time of Obama's birth who had a foreign parent had DUAL CITIZENSHIP. You can become a full-fledged NATURALIZED CITIZEN, but naturalized citizens CAN NOT BECOME PRESIDENT, only NATURAL BORN with two American citizens. You could have cameras in Hawaii while little Barry Soetoro was being born with proof beyond belief he was born in Hawaii, and that still wouldn't make him eligible to be pres.

No LOL, there is no requirement that the parents need to be "natural born citizens" but only that they are citizens of the US at the time the child is born. I don't know where you went to school, but when a statement says," a child of citizens", the word "citizens" is plural, meaning more than one, and there is no way it can mean only one of the two. Check a grammar book if you are still in doubt.

If your mother was not a US citizen at the time of your birth, then you are not a natural born US citizen. "Natural born citizen" is a legal term that was defined well before the US Revolution. Natural-born citizens, are those born in the country, of parents who are citizens. ( The Law of Nations, Vattel 1758, Book 1, chapter 19, paragraph 212) This is the legal text that was used by the founders of our nation.

Yes, and everyone born there since August 12, 1898 is a citizen, however, NOT all citizens born within the US are "natural born citizens", as this is determined by not only one's place of birth, but the citizenship of BOTH parents. In addition, no evidence has ever been shown to prove that Obama was born in Hawaii. Hawaii routinely issues Certifications of Live Birth to foreign born children.

This whole chain of logic is dumb. It only takes one parent to qualify for US citizenship. There's a whole generation of half-Vietnamese people who are my age who were born with dual citizenship because their serviceman dad was a US citizen and their mom was a Vietnamese citizen. My father was born the son of an Australian mother and a US father, and had dual citizenship for 18 years.
The Hawaiian State Department is the final arbitrator of this issue and they have provided their decision.

Well yes, your logic is dumb. The President is required to be a "Natural Born Citizen", which means that both his parents were US citizens and he was born in the United States. That is the rquirement, stated in the Constitution. How you or the Hawaii State Department feels about it, does not matter. It is the law. I've heard that the use of "Parents" in defining Natural Born Citizenship status is a collective noun. Meaning only one parent is necessary. I think it checks out and I'm signing off on the Birth Certificate issue.
Besides, let's face it. Birthers are grasping at straws based on vague technicalities. We are treating the Constitution as strictly as the Holy Scriptures. Some would say that is what we are supposed to do, but I say, No. It is not a flagrant breach of the Constitution. And it bends.

The Constitution goes on to allow a person who was a citizen of the United States at the time the Constitution was adopted to be President. A natural born citizen is a non-naturalized citizen. A person born in the United States and subject to the jurisdiction thereof is a natural born citizen of the the United States.

A "natural born citizen", is one who, by the very nature of his birth, is subject only to the jurisdiction of the nation in which he was born. The only way that can be achived is to be born within the US, and both of your parents being US citizens. Chapter VI, Section 97 of the Kenyan Constitution regarding dual citizenship :
Nobody over 21 is permitted to be a citizen of Kenya if he is a citizen of another nation, unless he renounces his other citizenship & swears an oath of allegiance to the Republic of Kenya.
ergo: Obama may have been entitled to Kenyan citizenship, but that entitlement was revoked when he reached the age of 21, being a US citizen through birth, residence and parentage.

That may be true, however, a natural born US citizen would not be in a position to hold citizenship in or ever have been subject to any foreign nation. Lacking access to Obama's original birth records, we can not say for sure that he is a US citizen, and we don't know for sure who his parents really were. A "natural born citizen", is one born in the country, to parents who are citizens. Having just one US citizen parent, will not qualify you as a "natural born citizen".

Well, seeing as the term 'natural born US citizen' does not actually have any precise legal definition, it is open to some considerable interpretation. John McCain's status as a natural born US citizen is also up for debate, being born in Panama to US citizen parents. But there were very few questions asked either in 2000 or 2008 regarding his eligibility.

It is interesting to note that in April 2008, all 100 members of the US Senate, including Obama, passed S. Res 511, declaring John McCain was a "natural born citizen", because BOTH of his parents were US citizens. Why would this rule apply to McCain, but NOT to Obama? In truth, the resolution is not legally binding, but it does demonstrate that the US Senate investigated McCain's citizenship status and eligibility, but NOT Obama's.

Also if you read the actual text of S. Res 511, the US Senate stated their finding, to be in keeping with the very first immigration law passed by Congress. That law was The Naturalization Act of 1790, which stated, "the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens". It did not say the children of a US citizen(singular), but the children of US citizens(plural).

This left the United States as the only place in the world, where the children of US citizen could be born, and be considered "natural born". It is worth taking the time to read those first 2 immigration laws. They are very short, and easy to read. The question is - did the supreme court in the 90's restore oh bomb duh's citizenship (the existing law required Americans to relinqish USA citizenship upon the acquisiton of antoher after birth) or retroactively recognize that he couldn't give it up?
If it restored his citizenship, he probably was natural born until he relinqished it by becoming indonesian. But, upon retoring it, he no longer was natural born.
If it granted retroactive reliief, he stayed natural born.

If Obama was not born within the United States, his mother was not old enough to pass citizenship on to him. So unless, he can prove that he was born in Hawaii as he claims, he was never a US citizen. By virtue of his adoption by Lolo Soetoro, he became a citizen of Indonesia, and he might still own that citizenship. He claims that his Kenyan citizenship expired on his 21st birthday, but, he has said nothing, about his Indonesian citizenship.

I am familiar with the law you speak of. It applies only to the ability of US citizens born abroad to pass their US citizenship to their foreign born children. My undersatnding (correct me if wrong) is that oh bomb duh's mom was born in the US (kansas), but I have seen no verification of that.
As I said, I do think you have something on the indonesian citizsenship issue depending on what the court said in the 90's.

No, But You are! Hawaii Revised Statute 338-17.8 allows registration of birth in Hawaii for a child that was BORN OUTSIDE of Hawaii to parents who, for a year preceding the childs birth, claimed Hawaii as their place of residence. Obama could have been born anywhere in the world, and still have a Certification of Live Birth from Hawaii. This law has been effect since 1911.

Another complicating fact (as if this case needed any more!) is that at the time of the marriage of Barack Obama Sr. to Stanley Ann Dunham in Hawaii in 1961, Obama was already married to a woman in Kenya, Grace Kezia Obama. Apparently tribal customs in Kenya at the time permitted that, but certainly bigamy is not recognized in either the UK or US. He never divorced her, in fact after earning his degrees from the U of Hawaii and Harvard, he returned to Kenya and bore two more children with her.

Yes, There is a record of a marrage license being issued, but no record of the marriage ever taking place. Michelle stated last July that Obama's mother was "very young and very single when she had him." If this is true, it would remove the age restriction from the immigration laws, and he would be a US citizen,no matter where he was born, but he would still not be a natural born citizen, because of his dual citizenship with the United Kingdom. Why does he still hide his Birth Certificate?

bigone, as to what you said about George Romney, didn't he drop out of the race due to a comment he made about being "brainwashed"? I agree with what you said about his citizenship status. It's very cut and dry. Just want to be accurate about why he dropped out because this would be a very valid precedent if it were regarding his status as a natural born citizen.

What I have stated, was my understanding at the time. I was in HS at the time, and this is how our history teacher explained it. The MSM may have also put for other reasons as well.

The Constitution cannot be held hostage to threats of mob violence. We can't let this "slide" just to keep some people happy. If Obama is not eligible, then the SCOTUS has to uphold the law of the land, and disqualify him. At that point, my understanding is that, if an elected president fails to qualify, the Senate votes for a president of their selection. A lot of people won't be happy, but that's the LAW. ='[.]'=

What if Obama argues that there is no explanation as to what a Natural Born Citizen is in the constitution? Didn't you say that the Naturalization Act of 1790 was repealed and replaced by the 1795's? Also, please note that the Naturalization Act of 1790 is very vague and doesn't mention children born in the US. It refers to children born "beyond the sea" or "out of the limits of the US" to "US citizen parents". The SCOTUS will interpret the word citizen however they want from the 1975's. No?
