1. It is not a sailboat. When under power, even with sails up, a sailing vessel is treated as a motor vessel.

2. Sailboats do not have absolute right of way when sailing, either. If a sailboat overtakes a motorboat, the sailboat must keep clear, because it is overtaking....

In this case, the rule is, "turn to starboard" which would have prevented this disaster.

Also even in the circumstance of a sail boat under sail that is not a right to have total disregard. Both skippers have the responsibility to give due distance and avoid crashes.
