No. I'm totally against spousal abuse, but killing someone like that is self defense. Him simply coming home isn't a threat to her. If he gets violent with her, by all means, kill the fuck, but getting drunk, smoking, and waiting by the door with a shotgun for him to get home is premeditated murder while under the influence of alcohol. Of course the guy deserves to die, but the courts won't see eye to eye with someone who got drunk before killing someone.
