I am a former soldier, and soon to be cop as well. I can tell you this that guard was could have legally done alot more if he felt nessary,but he played nice for the old man. Personally I would have given him one chance to leave, and if he refused he would have been detained and held in the security room until the police arrived, and would have persued going after the other guys.

Then the security guard had no authority to detain this man for public intoxication. The security guard can either ask the man to leave the premises or call the police. He has no right to detain him or even place his hands on him, and absolutely no right to put a choke hold on him when he tried to leave.

IN THE US-my state, the security guard CAN ask the people to stop filming on PRIVATE PROPERTY, such as a store, mall, etc. BUT they can NOT "arrest" the citizen unless they have PROOF he has stolen. If the guy refuses to open his coat, because they are suspicious, they can not DETAIN HIM. They have to SEE him steal. "WALKING LOPSIDED" is not enough reason to detain a citizen.

If you are asked to leave or stop filming-whatever, on PRIVATE PROPERTY, you need to do so. LEGALLY. That includes parking lots, sidewalks on the property-ANYWHERE on the property. You may step beyond the property limits and continue filming. From public property, you can film anything that you can see with your naked eye. Its very simple.

No, honey, they don't. Some have limited power of arrest, if they have received training and licensing for it, but most have the same powers as private citizens. Furthermore, the ones that do have deputy powers are still held to the strictures that apply to police, and that means appropriate force is to be used if necessary--and placing an old, unarmed man in a headlock is a bit of overkill.
