Even then there is no enumeration in the Constitution for the Federal Government to strip anybody of property without due process of law, including those in the act of rebellion, as they still need to be tried by law.
The Federal government later surcumvented this by passing the 13th and 14th Amendments by claiming they nor any government or persons shall be responsible for lost slaves.
