Let it come up for trial. I would think the defense of Waterboarding would be fairly easy to come up. All that would be necessary would be to have the defendants, those being President Bush, Vice-President Cheney, John Liu and others submit to several, say 10 episodes of waterboarding each. Say what maybe 5 or 10 minutes for each session over 15 or 20 questions where the answer they give is disputed.
In Boumediene v. Bush (2006), the U.S. Supreme Court struck down the restrictions on habeas corpus written into the Military Commissions Act. In other words, the Supreme Court had to step in to keep this Act from destroying the very heart of the Constitution (which is habeas corpus). The Republicans wrote this Act and the Democrats made sure that it passed. Both the Republicans and the Democrats are enemies of Our Constitution and our Bill or Rights.

Water boarding or any other form of torture implies a dissociation of the victimizer from the victim. A serious inability to put yourself in another men´s position. A lack of compassion, empathy or even pity is a seriuos carachter flaw before being a crime. If each of the defendents goes through each of the 10 episodes then they have obviously proved that waterboarding is not torture.
It would also be understandable if a personal physician might object because of health concerns. In which case a surrogate, someone like wife, child, grandchild could be subsituted.
I as well as probably many others would accept this type of defense as the ultimate adjudication that waterboarding was/is not torture.

In all honesty, most of us don't know if waterboarding is torture or not. It sure doesn't look pleasant. However I will accept on face value that Japanese were prosecuted for waterboarding as torture after World War II. I don't know if they were convicted or not.
President Bush and Vice President Cheney along with that attorney, what was his name John Liu or something like that state that waterboarding is not torture. Cheney I think called it enhanced interrogation techniques.

Let it come up for trial. I would think the defense of Waterboarding would be fairly easy to come up. All that would be necessary would be to have the defendants, those being President Bush, Vice-President Cheney, John Liu and others submit to several, say 10 episodes of waterboarding each. Say what maybe 5 or 10 minutes for each session over 15 or 20 questions where the answer they give is disputed.

Water boarding or any other form of torture implies a dissociation of the victimizer from the victim. A serious inability to put yourself in another men´s position. A lack of compassion, empathy or even pity is a seriuos carachter flaw before being a crime. Character flaws as serious as this could be prevented by making the development of a social and ethical conscience the main objective of integral education and healthcare.

I think he won't. Listen to what he says, and listen to how he says it. If he does order a prosecution, as would be the action of someone upholding the Law, I recommend he hires trustworthy bodyguards.
But, again, I think he won't move against Bush. That would, however, mean any future suspect of war crimes and breaking the Constitution only has to point to Bush and say, "But he wasn't punished, so why me?"
