  • Actually, the Border Patrol needs consent or probable cause ChounchMcGavin. That's why the agents waved them through - because they had neither:

    U.S. v Martinez-Fuerte (1976): "...We have held that checkpoint searches are constitutional only if justified by consent or probable cause to search....And our holding today is limited to the type of stops described in this opinion. -'[A]ny further detention...must be based on consent or probable cause.'"

  • Done my research michaelyanez. Drug checkpoints are illegal. So says SCOTUS in City of Indianapolis V Edmond. Besides, according to the Inspector General's Office, BP agents are routinely investigated, arrested & prosecuted for taking bribes to look the other way at these checkpoints & actual Border Ops are about 15x more effective at interdiction then these checkpoints according to a GAO study. So much for your research.

  • My only complaint about the people in this video is that instead of asking for the law that requires passengers to ID themselves they should have handed the agent a paper saying something like, "3 USC 1357(a)(3) authorizes you to search our vehicle away from the border, but the U.S. Supreme Court has ruled in United States v. Martinez-Fuerte that that law is unconstitutional and that you must have probable cause to search or detain."

Of course they are going to inspect the vehicle and ask for United State ID and who all is within the vehicle. It's standard policy for that job. They should have ordered you out of the vehicle, pulled it into secondary themselves and ran document checks on you and your passengers. Normally the agents at Sierra Blanca are dicks...they must've been tired that ngiht when you came through.

The authority to order occupants from the vehicle is in there as well. I know my authority, just like all the other agents do which yoive encountered. Bottom line is that you haven't won a lawsuit against CBP and wil never win one. Until you do, everything you say is moot. Winning against an indian tribe doesn't count by the way.

    With regards to winning a lawsuit against CBP, I don't need to. No agent has been foolish enough to drag me out of my vehicle yet for exercising my rights in a peaceful manner. You can thank the TOPD for providing feedback on what happens in such circumstances.

  • Don't know where you're getting your information from chamsdropz24 but it's clearly erroneous. I've never filed suit against CBP. I have been in court regarding checkpoint/roadblock issues on multiple occasions however and I've won every time. Details are available on my website and blog.

Two hours east of El Paso is the middle of fucking nowhere, which means they had to build infrastructure with our money -- housing, food service, what have you -- to support these inspection thugs.   • Okay, I agree with this video and not needing to answer to all the cop's demands, but for real, I'm glad they are checking peoples legal status. All the driver had to say was, "yes everyone here is an American citizen." If it went any further than that, then I'd ask the cop if I had to answer any more questions. I'd be glad to answer that question, especially if I knew I was on the border and it was a routine check point. either way, good video; and that cop was a nice guy

  • @ceasey0xoogurl No it is not a law - most checkpoints consist of asking a simple question.....citizenship.....t­hen they move on. They don't detain and rip car interiors out like many want you to believe. - like these guys get up in the morning, drop their kids off and get pumped to go mess with people. Funny that myself and everyone I know have somehow managed to never have a problem at a checkpoint - or anywhere else for that matter.

  • @SSILENTNATION Yeah I agree with what your saying; I would have just answered the question being that I'm happy these guys are there checking to see if everyone is a citizen; but if they were to try to search my car or something I'd probably resist that; most police don't give you a hard time and some do; it doesn't mean we shouldn't cooperate with the cops

    I suggest you watch the YouTube video "Don't Talk to Cops, Pt. 1". You might just realize why "cooperating" can get innocent people in trouble.

  • @ceasey0xoogurl not everything the authorities do is dictated by law. Much of it comes from discretion granted by judicial interpretations.

  • @alanturb If they were any thing close to "Gestapo" - they would have simply kneeled them on the side of the road and shot them in the head. But they didn't - they communicated - or at least tried to with mumbly wumbly at the wheel, and then let them go. The only people with an attitude on this video are the two pretend freedom fighters in the fart box affectionately called Marv.
