Asking someone to identify themselves is not a search, and the Fourth Amendment does not include right to anonymity. The officer could at least have answered the question about the driver by asking for his driver license, since you must provide passport, birth certificate, etc issued in U.S. to get a valid driver license. This obviously wouldn't have helped with identifying the passenger who was recording the thing.

Asking someone to identify themselves is not a search, and the Fourth Amendment does not include right to anonymity. The officer could at least have answered the question about the driver by asking for his driver license, since you must provide passport, birth certificate, etc issued in U.S. to get a valid driver license. This obviously wouldn't have helped with identifying the passenger who was recording the thing.

When a judge orders a checkpoint to protect against a specific threat to the public, that is not unreasonable. I am quite amused when some people actually think they have the right to privacy in public. You have the right to privacy when in private - such as your private business or your home. You can travel freely without proving citizenship, avoid the border if it bothers you. I believe there is actually a map of the internal checkpoints. There is nothing unconstitutional about it. I have yet to see any border patrol checkpoint outside maybe 50 miles from the border. I have also never been asked by a border patrol agent for my ID or my destination.

It does not really matter what you have seen, check the videos here, they show the border on the map and the checkpoint that they are currently at which is inside the country, they ask the driver and passangers for ID, where they have been and where they are heading to.

I agree that it gets a bit tedious to go through checkpoints, but it's a matter of security. I've known of cases where illegal immigrants will pose as American-born citizens, perfect accent, valid social security, everything, and were caught mid-process and deported. The fact that there are tons of checkpoints doesn't annoy me, it just makes me feel safer. Anyone agree with this?
