The judges overturned the vote b/c it violates the right to equal protection of the law. Its their job to overturn unconstitutional laws. 8 violates their rights. Defeat of Proposition 8 only allows same sex marriage to remain as law in the State of California. There's no precedence that with same sex marriage, that public schools will be forced to teach about same sex marriage. Nor that churches will lose their tax-exemption status. The California Appellate Court only said that gays and lesbians must be allowed the same rights as heterosexuals to marry, and that's it. There's was nothing discussed beyond that!

Don't equate "sexual minority" with "ethnic minority". Talk about rights. If a group of people with a special sexual feeling or pleasure can be granted a "right", then we should also grant pedophiles or incest groups with the same right. They are also a "sexual minority".

Civil right is for minorities of different skin color, an unchangable trait. Sexual feeling or sexual behavior is changable. They should not be given special rights. I have gay friends who changed into straight.

The reason why paedophilia or incest does not deserve rights, is because these practices are inherently nonconsensual. The recipient of the paedophile/incest's actions is harmed both emotionally and physically.
