Does everyone know that you are not suppose to be out and driving without having identification?? You have to have a legal drivers license to be driving. If not...you will be arrested until you can prove your identity. It's the law! Forgetting your ID is not an excuse. No. If a person with my brown complexion (half white half puerto rican) gets pulled over will the officer ask for proof of citizenship because i could be an illegal immigrant, i don't know about everyone else but i don't carry around a birth certificate around with me while i drive. one of my coworkers was one of the first persons affected by this law. He was driving and had forgot to turn on his headlights, and when he was pulled over, the officer arrested him for not having proof of citizenship. He was brought in and charged and then later released when they found he was actually born in this country. But the damage had already been done. He was wearing his work uniform in his mugshot photo and was subsequently fired because of it. Fuck SB1070

We still talk about who the lifeless jackoff is in the corporate office that saw the nightly news/newspaper and immediately noticed the small grocer logo in the right of the photo and thought that there would be some sort of outrage over guy being falsely arrested. Maybe they just thought or chain didn't need any bad publicity. Either way, it sucks. He was a pretty cool guy. It is not his responsibility to prove his innocence, but the states responsibility to prove he is guilty. Someone else at the store had been pulled over for not having a license and was able to keep their job. And I have a question for you. How would you be able to differentiate between a legal and illegal immigrant?

The law does not say if your hispanic have papers ready. Police cannot question anyone who is hispanic only if they are breaking a traffic or any other law are subject to questioning as is everyone who breaks a law. WHY WHY WHY do so many people not understand that if a person is in the country illegally that they must be dealt with accordingly? They are not going to be going door to door demanding papers, EVERYONE who gets pulled over or part of a police envolvement are required to issue proof of identity, so they know who they are. whats so wrong with that. Draconian? Since when is being deported for illegal sneaking into a country is a heavy punishment? Its been a law since 1940 that all legal reisdents must carry their green card with them at all times. And in the U.S. a cop can ask you for ID and for the title to your car without a reason, why not your green card? If a cop wants my ID, I hand him one, no problem.
@JJJohnson32 well yea a cop can ASK for your id without a reason. he can also DEMAND to see your id which would then require him to give you a valid reason. in general if you are minding you're own business, the cops cant force you to show id. why? b/c there is no law stating that you MUST carry an id with you at all times (unless if you're driving). if a cop won't let me walk away without showing my id, he would then have to give me a good reason why i'm being detained.
@ThePhnxman1 well you are only supposed to show it under reasonable suspicion. even though arizona insists that it is not based on race, the law is vague as to what constitutes as reasonable suspicion or what they do to evaluate of whether or not someone may be an illegal alien, and it's probably b/c "look for the beaner-looking guy" may not get a good response. I mean even with a LEGAL stop an officer still tells you what you did wrong before he asks for your ID.

SB1070 does not authorize Police to stop anyone on the street and ask for immigration status UNLESS they FIRST have reasonble suspicion that a crime is being committed. I believe that is nationwide.
@ThePhnxman1 and that's how it's supposed to be, but have you seen some of the news reports? some guy was stopped asked for his ID, his FRIGGIN SSN, and THEN his birth certificate. when he wouldn't show his birth certificate b/c it was at home (for obvious reasons) he was arrested and was not released until his wife brought it to the police. of course it's nationwide that you aren't stopped unless if the have reasonable suspicion but how cute of you to think that's how it always is.

In many states, if a person does not have their driver's license when they are stopped, they can be detained (arrested) until they prove who they say they are. I am required to have my DL on me when I am driving, and the LEGAL immigrants are required to have their "papers" in their possession AT ALL TIMES.

The only other CITIZENS I know whose English is that bad are over 70 yrs old: so my guess is that he was raised outside of the U.S. (and therefore needs an US Consular ID stating so), or he bought the Birth Certificate and got a driver's license and SS# with it.

@ThePhnxman1 there has been no discussion or question of the authenticity of his birth certificate or papers. you jumped to that conclusion by yourself. i have friends born and raised in the us who's english is about the same. the fault lies mostly in the parents who are residents and can't speak english very well. does it mean they were raised abroad? no. doesn't necessarily mean they have a fake identity either. it might be, but i would not rely on english pronunciation alone.

I have MANY friends whose parents are here ILLEGALLY, but their English is alot better than that. I also know of some US CITIZENS who were raised in Mex., whose Eng. is just as bad.

@munky3691 - Yep. Those are the things that make for a proper investigation. The authenticity of the Birth Cert. is not the real issue: the probable cause was there.
In Arizona, alot of ILLEGALS received driver's licenses before a law was enacted that they needed a BC to appply for one and were "grandfathered" in, and many also received SS #'s through the mail. Many BC's have also been sold and stolen.

@munky3691 - The licenses and SS #'s are not illegal, because many given given out before the new laws were enacted, and many ILLEGALS obtained them that way. However, THAT does not not make one LEGALLY in the country.
As for the arrogance: the marches with Mexican flags, their demands to be recognized as legally here, their demands for equal rights as citizens while breaking numerous laws (this is aside from their human rights), and their open prejudice against the Americans.

To be fair, I do not attribute prejudice to Mexico's "middle" or more educated people: there exists those elements in "La Raza", "Chicanos Por la Causa", "Mecha", "Aztlan", etc., that manipulate the people for their own political agendas.
Lets be honest the “papers” that people are talking about, is called a drivers license or a state issued picture ID, or a passport, or military ID. In the state of Arizona people are required to carry one of these forms if ID. That’s nothing new. If you are stopped by an officer and you cannot produce one of these forms of ID or otherwise prove that you are who you say you are, you will be detained until the authorities can identify you. That’s nothing new.

Halfway through the drive, she realizes she forgot her driver's license at home and of course, we're from a state where we don't need to have identification at all times. If you and you fiancé are pulled over in Arizona and she doesn’t have ID, they will simply ask her name, DOB, and SS# if she can provide that, and the description that comes back and matches her, there will be no problem. If they suspect she has provided a false name, she will be detained and fingerprinted. That applies to everyone, you, me,everyone.

That leaves enforcement up to local agencies. Every state has people in jail on immigration holds. Some cities choose to look the other way. This law requires that all cities enforce federal law to the fullest extent allowed by federal law. That is all this law does. Every other part simply mirrors federal law.
Just to help make my point that this law simply mirrors federal law, Erik Holder’s justice department is suing on the grounds that it violates the supremacy clause of the constitution. Why is that so telling? If they sued on the grounds that this law is discriminatory, than they would be forced to concede that federal law is discriminatory. Look I have problems with this law too. But if we are to fix this law we must first be honest about this law.

one of my coworkers was one of the first persons affected by this law. He was driving and had forgot to turn on his headlights, and when he was pulled over, the officer arrested him for not having proof of citizenship. He was brought in and charged and then later released when they found he was actually born in this country. But the damage had already been done. He was wearing his work uniform in his mugshot photo and was subsequently fired because of it. Fuck SB1070

We still talk about who the lifeless jackoff is in the corporate office that saw the nightly news/newspaper and immediately noticed the small grocer logo in the right of the photo and thought that there would be some sort of outrage over guy being falsely arrested. Maybe they just thought or chain didn't need any bad publicity. Either way, it sucks. He was a pretty cool guy. His manager was mad because he was called back from vacation to work the other guys shifts.

@oiyabastard it's the fact that he was pulled over because of a minor offense and then brought in because he couldn't prove he was a citizen. It is not his responsibility to prove his innocence, but the states responsibility to prove he is guilty. Someone else at the store had been pulled over for not having a license and was able to keep their job. And I have a question for you. How would you be able to differentiate between a legal and illegal immigrant?

The law does not say if your hispanic have papers ready. Police cannot question anyone who is hispanic only if they are breaking a traffic or any other law are subject to questioning as is everyone who breaks a law. WHY WHY WHY do so many people not understand that if a person is in the country illegally that they must be dealt with accordingly? They are not going to be going door to door demanding papers, EVERYONE who gets pulled over or part of a police envolvement are required to issue proof of identity, so they know who they are. whats so wrong with that. The law is the law and set for a reason. The AZ immigration law is much more complex than my explanation, but i feel its valid.

The FEDERAL law preventing unauthorized entry of non-citizens is, by this liberal presentation, illegal as well. it is a Federal Law that was ratified by all states that is being broken by illegals in any state. BY LAW, it is ALREADY incumbent on law enforcement to halt any illegal activity. Bank robberies in progress are routinely responded to by local law enforcement. Draconian? Since when is being deported for illegal sneaking into a country is a heavy punishment? Its been a law since 1940 that all legal reisdents must carry their green card with them at all times. And in the U.S. a cop can ask you for ID and for the title to your car without a reason, why not your green card? If a cop wants my ID, I hand him one, no problem.

@JJJohnson32 well yea a cop can ASK for your id without a reason. he can also DEMAND to see your id which would then require him to give you a valid reason. in general if you are minding you're own business, the cops cant force you to show id. why? b/c there is no law stating that you MUST carry an id with you at all times (unless if you're driving). if a cop won't let me walk away without showing my id, he would then have to give me a good reason why i'm being detained.

@ThePhnxman1 well you are only supposed to show it under reasonable suspicion. even though arizona insists that it is not based on race, the law is vague as to what constitutes as reasonable suspicion or what they do to evaluate of whether or not someone may be an illegal alien, and it's probably b/c "look for the beaner-looking guy" may not get a good response. I mean even with a LEGAL stop an officer still tells you what you did wrong before he asks for your ID.

SB1070 does not authorize Police to stop anyone on the street and ask for immigration status UNLESS they FIRST have reasonble suspicion that a crime is being committed. I believe that is nationwide.

@ThePhnxman1 and that's how it's supposed to be, but have you seen some of the news reports? some guy was stopped asked for his ID, his FRIGGIN SSN, and THEN his birth certificate. when he wouldn't show his birth certificate b/c it was at home (for obvious reasons) he was arrested and was not released until his wife brought it to the police. of course it's nationwide that you aren't stopped unless if the have reasonable suspicion but how cute of you to think that's how it always is.

In many states, if a person does not have their driver's license when they are stopped, they can be detained (arrested) until they prove who they say they are. I am required to have my DL on me when I am driving, and the LEGAL immigrants are required to have their "papers" in their possession AT ALL TIMES.

@munky3691 As I stated before, his English is so B-A-D that I would have investigated him still further. The only other CITIZENS I know whose English is that bad are over 70 yrs old: so my guess is that he was raised outside of the U.S. (and therefore needs an US Consular ID stating so), or he bought the Birth Certificate and got a driver's license and SS# with it.
Apparently, his "wife" is sold on it.

@ThePhnxman1 there has been no discussion or question of the authenticity of his birth certificate or papers. you jumped to that conclusion by yourself. i have friends born and raised in the us who's english is about the same. the fault lies mostly in the parents who are residents and can't speak english very well. does it mean they were raised abroad? no. doesn't necessarily mean they have a fake identity either. it might be, but i would not rely on english pronunciation alone.

I have MANY friends whose parents are here ILLEGALLY, but their English is alot better than that. I also know of some US CITIZENS who were raised in Mex., whose Eng. is just as bad.
My conclusions were based on actual observation. Still, I would have conducted a far deeper investigation.

@ThePhnxman1 well yea i guess it is more of a case to case thing. and yea you're right. i rewatched the video and his mother is in mexico. still, he had a birth certificate. i imagine when his wife took it to the police department that they would have made sure it was authentic since they went through the trouble of arresting him and all. i still don't think that his lack of perfect pronunciation is enough to take that leap because he had good grammar. but that's just me.

@munky3691 - Yep. Those are the things that make for a proper investigation. The authenticity of the Birth Cert. is not the real issue: the probable cause was there.
In Arizona, alot of ILLEGALS received driver's licenses before a law was enacted that they needed a BC to appply for one and were "grandfathered" in, and many also received SS #'s through the mail. Many BC's have also been sold and stolen.
What irks me the most is the ILLEGALS' arrogance.

@munky3691 - The licenses and SS #'s are not illegal, because many given given out before the new laws were enacted, and many ILLEGALS obtained them that way. However, THAT does not not make one LEGALLY in the country.
As for the arrogance: the marches with Mexican flags, their demands to be recognized as legally here, their demands for equal rights as citizens while breaking numerous laws (this is aside from their human rights), and their open prejudice against the Americans.

Lets be honest the “papers” that people are talking about, is called a drivers license or a state issued picture ID, or a passport, or military ID. In the state of Arizona people are required to carry one of these forms if ID. That’s nothing new. If you are stopped by an officer and you cannot produce one of these forms of ID or otherwise prove that you are who you say you are, you will be detained until the authorities can identify you. That’s nothing new.

Halfway through the drive, she realizes she forgot her driver's license at home and of course, we're from a state where we don't need to have identification at all times. @SocialDissimulation I’ve lived in Arizona for 25 years. The requirement to show ID has been the law at least that long. If you and you fiancé are pulled over in Arizona and she doesn’t have ID, they will simply ask her name, DOB, and SS# if she can provide that, and the description that comes back and matches her, there will be no problem. If they suspect she has provided a false name, she will be detained and fingerprinted. That applies to everyone, you, me,everyone.

@SocialDissimulation Are you really that dense? The Arizona law takes word for word from Federal law. I know that is straight from Arizona law, they wrote it straight from current federal law. If you cannot prove that you are who you say you are you will be detained, until the authorities can find out who you are, regardless of citizenship. That has been the law long before 1070.

@SocialDissimulation Run into many federal cops where you live do ya? I doubt it. The federal government doesn’t have an effective local enforcement agency. That leaves enforcement up to local agencies. Every state has people in jail on immigration holds. Some cities choose to look the other way. This law requires that all cities enforce federal law to the fullest extent allowed by federal law. That is all this law does. Every other part simply mirrors federal law.

Just to help make my point that this law simply mirrors federal law, Erik Holder’s justice department is suing on the grounds that it violates the supremacy clause of the constitution. Why is that so telling? If they sued on the grounds that this law is discriminatory, than they would be forced to concede that federal law is discriminatory. Look I have problems with this law too. But if we are to fix this law we must first be honest about this law.

I dont know. I read the law, and it repeatedly stated that neither ethnicity nor country of origin can be taken into account when suspecting someone of breaking an immigration law.

The only thing "Un-American" is millions of illegal alien scam artists violating U.S. borders & immigration laws & living in the U.S. with all of the benefits but above our laws!!
Illegal aliens are bankrupting U.S. hospitals, public schools, welfare rolls, public housing programs, jails, courts, prisons, police departments, infrastructure & etc.
