It was unconstitutional. Most of what government does today is unconstitutional. The constitution gives specific and limited power to do specific activites such as: run a post office, build roads, regulated interstate commerce, etc. This is not within their power. Unfortunately we have not been living within the confines of the constitution for a long period of time. When she says "What provision in the constitution gives you authority etc.", she shows that she has no understanding of the constitution. One thing it does is give the legislative branch (congress) power to pass law, like The Federal Reserve Act of 1913, which gave them the power to do everything they've done thus far.

Her question is as ridiculous as going up to a police officer and asking him "Officer, what part of provision constitution allows you to give me a speeding ticket?"

It is not ridiculous. He takes an oath to the constitution and the congress passes unconstitutional laws all the time. He needs to look to the constitution first and then interpret the law and determine if the law is unconstitutional.

The reason he doesn't seem to understand the question is because our overlords live on a different level, they never consider the Constitution, (ie. limitations on their power). As long as Congress votes for something, it is legally, politically, morally justified. If they do something in the name of the "common good" or "public safety" then the ends always justify the means and everything is irrelevant. First off, the Supreme Court is completely fraudulent and should be recognized as such and ignored by the States. 

Secondly, the States have final say in what is Constitutional, not the federal government.

Also, Marshall used the necessary and proper clause and said it granted implied powers, which is an extention of Hamiltons implied powers thoery.

Also, the necessary and proper clause says to carry into the 'foregoing powers' not the 'implied powers'

So basically, the Supreme Court is completely fraudulent and so is the implied powers
