People have been traveling by boat between the Hawaiian islands for centuries and they haven't come anywhere close to destroying the environment or even changing it. This boat won't either. Would I take the Ferry instead of the shuttle flights??? No doubt. On the mainland I also take the train instead of flying whenever time permits as well. Trains are considered probably the most environmentally friendly mode of transport while jet aircraft are dead last. The Ferry will encourage passengers to interact with each other and take people off the inter-island air shuttles and that's a GOOD thing for the environment!

LOL.. don't think the SF will be going 42mph in open waters. Anyone that fishes knows that Hawai'i's water in the open channels are not flat. You take a kracks. Why you think the SF cancels so many trips between Oahu and Maui. SF travels only during day light hours unlike Young Brothers and NCL cruise line and lets not forget those Dinner Cruise Boats like The Star of Honolulu and the Navatek. which I doubt had to get a EPS.

This video is a joke. Why target only the Super ferry? Why not grumble about NCL?, it's twice the size of the SF and travels between islands at night. Why not Young Brothers Tug and Barge? who also moves between islands at night. How bout all the commercial boats? Whale watching boats, para sailing, chartered fishing boats? etc... Plus the humpback whales are here only 4 to 5 months in a year.

Anyway, the point remains, this ferry is going to go inter-island. Meaning you'll see people from Oahu, Maui, and the big island, travel all over. The point of the ferry probably can move people, but its mostly for just travelling. It's not just for whites. Other Hawaiians, Asians and others will be using it too.

Would I take the Ferry instead of the shuttle flights??? No doubt. On the mainland I also take the train instead of flying whenever time permits as well. Trains are considered probably the most environmentally friendly mode of transport while jet aircraft are dead last. The Ferry will encourage passengers to interact with each other and take people off the inter-island air shuttles and that's a GOOD thing for the environment!

Easiest answer: Mandatory $10 million fine for every whale the Superferry hits.
Fine them, and they will definitely come up with a safe way to conduct business. If their ferry is truly safe, then the $10M won't be an issue, so no big deal. It is simple economics.
(frankly there is no reason the SF can't just run a small chase ship ahead with sonar, it could be AGV or remote piloted. Fine them $10M/whale, & they'll implement just such a solution)

I did not disagree with you on one point :) What the court ruled is that the ferry is not exempt (even by the governor) from not requiring a EA and maui courts say, don't come here till then.... The ferry can go to kaui but they'll get their windows smashed in by the locals with out an EA

The reason why it is illegal is because it didn't do an Environmental impact study, which the Hawaii supreme court ruled that it needed one to operate.... Therefore it was operating illegally. Got it? Why it was in operation is because Governor Lingle is Corrupt and gave it a free pass
