It falls under "potential" life, not "actual" life. Black people, although "actual" life, weren't considered people, and that was wrong to consider them less than human. However, what Rick is asserting is rather wrong of him to assert in the first place.

So he clumsily tried to make the point that of all people, surely a black man should be in favor of equal rights for the unborn because blacks have experienced a similar oppression.
