Go into iTunes and click restore. It will fix it. Also, you do have a warranty. Every iPhone and iPod touch comes with a standard 1 year warranty.

As far as apps running slow thats seperate and there is actually a 99 cent app that helps free up memory. WHICH IS MUCH easier than restarting once a day

i was having a problem with mine going on and off slide to cancel etc...

i put mine near a heat source for eg. on top a cable box vents where the heat vents out for a few days,,, surprisingly it stop shutting down. and now works perfect,
