  • This is all very interesting! Yes, there is a “thought crime” quality attached to the discourse connected to hate crimes. But, I am concerned with how the courts might discriminate between the motivation behind a crime and the attitudes that lead to it. These are very subjective and slippery concepts, no?

  • I have personally been the vicitm of "hate crimes" on two separate occasions, but I strongly oppose legislation against them. It should be obvious to anyone with even a rudimentary understanding of the Constitution's first amendment that such laws are flagrantly unconstitutional. As Americans, we have an inalienable right to whatever we think or feel, about anyone or anything. Without freedom of sentiment and freedom of conscience, the first amendment is meaningless.

  • What about the difference between 1rst, 2nd and 3rd degree murder? We call it 1rst degree murder if you planned it and 2nd degree murder if it was a crime of passion. We give longer sentences for those who THOUGHT about it before hand. Would you argue that murder is murder and it doesn't matter if it was because you were drunk driving(3rd degree murder) or because you planned it well in advance? If you think the above is fair that would give good precedence for the idea of hate crimes.

  • I agree completely. Murder is always an act of hate on whomever is killed. I'm not ignorant enough to believe that race, sexual orientation, or religious idenitity don't factor in to the decision of someone to kill people because there are sick people who kill for that very reason. But hate crime laws state that one murder is greater than another and thus one life has more worth than another life.

  • The fact that you are "impressed", that a conservative-minded individual can show political and social insight, is strongly suggestive of the influence that popular media has had upon you (read: elitist, cultural-Marxist liberals). You might benefit by reflecting upon the noted differences between liberal (lowercase "L" cultural maxist, collectivistic) and classic Liberal thought, as in the likes of J.S. Mills. There is some commonality between the latter, however, the differences are stark.

  • Hate is not criminalized in this bill. Freedom of speech is not criminalized. The bill states as much. There is no such thing as a "thought crime." There is such a thing as intent. That is why there are first, second and third degrees of assault and murder. That same principle, used for years in the courts, is simply being applied in this bill.

And specifically because these crimes address minorities, local police agencies are often lax or unwilling to address them properly. Hate crime?     She actually requested they not be put to death. Which may have influenced their sentence. I don't know how I feel about that. Part of me wants to say she's a bigger person than I would be able to be. Another part of me thinks she's a limp wristed fool whose actions may have prevented full justice from being carried out.

  • I stongly feel that homosexuality is against God - see the book of Leviticus and you will see God's disapproval for homosexual behavior. I'm not convinced that the gay-lifestyle is caused by genetics. I do feel that gays have the right to live their lives as they so choose. Hate crimes undermine the cornerstone of our legal system - Equal Protection Under the Law! Matthew Shepard's killers deserve the death penalty, but not because he was gay, but because he was a human being!

  • Mose's law was written by God Himself. Also, Mosaic law was never completely abolished or contradicted. Jesus fulfilled all previous laws and covenants between God and man. Portions of Mosaic law were lifted by God, but many sections still remain in full effect.

  • I've always believed, and continue to believe, that homosexual acts are a sin. The same goes for any number of other acts that are perfectly legal and that many of my friends participate in.

    I do not seek to make those things with which I disagree illegal. Laws cannot really change hearts, and in fact, it is an injustice to all consenting adults who choose to participate in certain acts. Neither do I want people who disagree with my views to regulate and legislate my thoughts.

  • It's worth debating whether hate-crimes law is a good idea, but the legislation Obama signed merely adds sexual orientation to language that has been on the books for 40 years addressing crimes motivated by the victim's ethnicity or religious preference. So if the legislation is wrong, at least now it is more equitable. It was kind of sick that religious people enjoyed certain protections that gay people did not.

    How do we know? The problem with that assesment is that the Ten Commandments are mutually exclusive, while Moses' Laws are regarded as Moses' Laws.

    Reading the bible, you clearly see it says "The Ten Commandments of God", then goes on to list them, then it says "The Mosaic Laws", and it goes on to list those.

    If Moses' Law = God's Law, why are they exclusive? And it never said Moses was inspired by God to write those laws.

  • Actually 5 black guys who watched Mississippi burning went on a spree attacking whites. They actually got convicted of a Hate Crime. But i had to go to Federal Court. I fully supported this. Instead of removing hate Crimes i say we push to make sure if you can prove that someone is attacking whites for the sole purpose of hating whites that the hate crime gets slapped on them.

  • I suppose we've all had moments in our lives we've said things that later on we regretted. It happens more often when facing an attack, verbally or physically. Responses are usually born out of hate or fear. But to have the gov exercise its police power tying speech and violence together is dangerous. It has taken political correctness to the next level. The next step is to punish speech in the name of preventing violence, rather than addressing the violence after the fact.

    But a person 's thought and intent do matter. If I were to carelessly kill someone vs purposely kill someone, should I get the same punishment for either act. Today, we would consider the former manslaughter and the latter 1st degree murder. Not to forget we also have 2nd degree murder(spur of the moment).

  • The legal system today takes into consideration the person's motive and intent. I don't see how adding an extra layer of hate crime is philosphically that different to what's already taken into consideration.

    Not only that, but hate crimes murders are worse than normal murders because of the added social tensions they come with. Society as whole loses more due to hate crime murders than normal ones. WW1 was started because of one murder across national/ethnic lines.

For example, my thought and intent over what weapon I would use to murder a man is irrelevant; all that would matter in that case is that I intend to murder the man.

You say that the two cases are equivalent but your friend's ACTIONS got him the a**whipping, but the gay guy's EXISTENCE got him his. In principle I think all hate crime should be treated separately, but in practice it's just too difficult to apply even-handedly. But to claim the application of hate crime to the Shepard attackers is a violation of their free speech is too much.

  • How would this not be equal to everyone? Does this legislation specifically state that a Hate crime comes into affect only when a majority person abuses a minority person. Hate is Hate. If a black person attacks a white person because he is white , I'm pretty sure the hate crime law would come into play.

  • I could be wrong, but I dont think this is what the legislation is about. A white person attacking a black person wouldn't be hate crime unless there was some evidence for it. Also, I would imagine the burden of proof would lay on the defense.

  • Not necessarily. The Leviticus verse only refers to gay sex. Any gay couple that DOESN'T have anal sex, according to this verse, is not really sinning (considering there are gay couples out there like that). Plus, most or all of the verses dealing with homosexuality in the Bible specifically refer to gay men and make no mention of lesbians.

  • I totally agree on hate crimes. Violent crimes are violent crimes, and punishment shouldn't take into account "what they thought" about certain minorities they attacked or didn't attack. They should still get the highest punishment possible just for doing such heinous things.
