Truth: The biggest key when you owe money is constant communication. They keep a record of it all and will work with you with great flexablity for 1 reason:
- They don't want you to go bankrupt
- Its not usually cost effective for them to sue you
First part of the call, "i need to inform you that we are debt collectors and any information obtained can be used to collect a debt and this is an attempt to collect a debt." Secondly, Analog Hole, creditors can still arbitrate you and seek judgments on any assets, and pursue legally whatever necessary regardless of payment history. Thanks for playing, though.
If I call my mortgage company to schedule an on-time payment, they say that they are a debt collector. Because they SOMETIMES act as a debt collector, they put that notice in there, sort of a CYA move (cover your ...). So that alone does not suggest that it's a third party collector. You are right though, even if you are only a single day late, a creditor could sue you and/or execute any number of attempts to collect. Most of course don't.
What you've just done here is made a 'Verbal Contract' to make a payment on the 15th. That can be used against you by the creditor my friend. Never agree to any dates. If you're broke, send one buck a month, then at least you can say, hey look, it's the best I can do, and I'm trying. Then they can't sue. Peace!
Good points about not 'solidly' confirming a date, it is a verbal contract that is recorded. That said, its extremely unlikely they'll bring litigation towards you unless you cease payments altogether & its a large loan amount.
NEVER EVER MAKE A DEAL WITH THE PREDATOR DEBT COLLECTORS! YOU NEVER HAD A CONTRACT WITH THEM, WHY PAY THEM? YOU ARE NOT OBLIGATED!

Everyone. Here's how you fix it
Take that credit card and cut it up.
CALL THEM and cancel the account.
Don't just stop using it because they are currently working on a new penalty charge for "NOT USING" your card.
They WILL get the message when 40 million people call them up and say NO.
They wont have a choice but to fix it.
When your money stops flowing into their pockets. They will hear you.
No violence. No weapons. No lawyers.
Just stop using the card and they WILL FOLD
Easy as that.

Sounds like a creditor's internal collections department moreso than a collections agency or a junk debt buyer. Totally different animal there.

Yeah... it's REALLY easy for them to be calm and collected when you are calling THEM about making payments.
