This goes to show they all work for the shadow government. From Carter to Bush to Clinton to Obama they are all the same--destroying our rights and freedoms. I guess they don't want to end up like Wellstone--or maybe like those guys who were against the Patriot Act and received the "military grade" anthrax in the mail. Thank you for the positive words at the end, Judge Napolitano.
Wow - was that enlightening! I didn't know that our rotten-to-the-core federal government had re-defined the phrase "financial institution" to include every business people normally do business with, including restaurants, ISPs, and the post office. So our privacy is basically dead, along with the Fourth Amendment. That "change" happened in 2003, under President Bush, who signed it into law. Bush was quite a tyrant, just as Obama is.
I love this guy. He is right on in everything he says EXCEPT this: when he mentions Congress seeing information that we haven't and voting to suspend our liberties, he doesn't seem to consider what effect that information had on their opinions. Basically, waterboarding works, and although that information was obtained illegally under the Constitution, it has the power to sway the votes of a legislative body.Otherwise, this man is a genius and a brilliant speaker, and I strongly support his ideas
Why or we not gearing up for a revolution? Every thing and more that caused us to revolt from England is now being done by a out of control government.
@TheUnitedNewsNetwork It may in fact come to that, but people like George Soros and his goons have the organizations in place to manipulate things during chaos, and it I am afraid would turn out very badly for freedom lovers at this point. There are still no where near enough people who understand what is happening. More people are waking up all the time though.
Most of the abridgements of human rights listed by Judge Napolitano happened during times of war: the Civil War, WWII and the current wars in the Middle East. Has anybody considered the role of the military in influencing these policies?
It's fear, not the military that influences these policies. Fear of the dangers if we don't allow the government to catch the "bad guys." Fear that people may consider you not patriotic if you don't support the government when they are trying to catch the bad guys.
In all, the people (sheep) shape these policies. Not Doing Anything shapes the policy. Then again, it's pretty hard to keep track of everything that the government does.
why cant lawyers challenge the law - is there a high court in america - a custodian of a constitusion? What I am saying if a law is passed in breach of the constitusion in the US WHY CANT it be challenged by a public member and get it deauthorized? Is there such a think in the US
@jacobm8tysek The plaintiff, accuser, must have standing, which is to be personally affected by a law (to be hurt by it directly), to litigate, press charges, against the defendant. That is why the USA PATRIOT act is so egregious because it circumvents the principal of standing.
@kenshinfreak3500 ...thanks for your comments.. sounds like a really f*cked up situation there in non-legal terms.. I heard this patriot act was passed quickly with little review.. So basically...people cant challenge the law.. due to the patriots act.. would this not be in conflict with your consituation.. ? No dought there must be something about fair trial, right to be heard, rights to a jury?
@jacobm8tysek Yes the Patriot act was passed very quickly and with little review. What I was writing about though were self written search warrants, which do NOT require the review of an independent judiciary, and if one receives a self written warrant they will violate part of the Patriot act law if they tell anyone about it. Yes I believe it is in conflict with the U.S. Constitution, but because of what I just explained anyone personally affected by it cannot challenge it legally.
@jacobm8tysek Yes there is a high court in America, it is the United States Supreme Court which is the court that handles issues of constitutionality.
@kenshinfreak3500 so much for a democracy, so much for liberty and justice and fairness and equality. why doesnt Obamma repeal the legislation? This is crazy. such for the government working for the people... when you start having laws like this and jails in cuba which violate personal autonomy and rights to trial.. and president who say to a nation or to another country prior to an invasion they are freinds, and will respect civilians then blanket bomb a city.. even communist nations dnt do tht
@jacobm8tysek That was rather depressing. If one's thinks about it though all of these problems can be fixed, at least if Americans are willing to do the right thing even when it is harder to do so. Also the patriot act can technically be repealed by Congress, although instead the current congress just extended it. There is always hope that the next Congress or Administration will fix some of these problems and if the American people are willing then nothing with stop us.
@kenshinfreak3500 I do agree... I see now why so many nations did not want to support the American war and I can see now the issues that the modern world is facing, issues that lingure in the back door and effect a minority, but as long as the majority are not effected, these silent laws pass in darkness... There are similar laws in Australia coming through laws that outlaw groups, make them illegal, if one can do that, then what stop them frm baning religious groups etc. Def the new control!
iam new to the United States, been here short 6 yrs and iam eager to learning about the constitution and my rights ,as my responsibillities as well ,thanks very much Judge for clearing some details
