This is weird because there's a documentary (Every F---ing Day Of My Life) about a woman who killed her physically abusive husband with the help of her son and they were both sentenced to ten years in prison. I don't see how a kid who didn't actually take part in the murder could a sentence worse than an adult who did.
If my son were to murder me I would never want him to spend life in prison which is a fate worse than death. If I were capable I would forgive him and I would only want him to get physiological help. I`m in Canada and got Charged with Threatening and Threatening with a Deadly Weapon, even tho the gun was not loaded, and the other teen that i threatened was a block away. He called the Cops, i got arrested, spent the night in jail, i got printed, went to video court, then had to go to provincial court, and then i was notified i was being charged as an adult, my dad got me a lawyer .And my lawyer made a deal. JUVENILES SHOULD NEVER BE TRIED AS ADULTS. Our justice system is so hopelessly fucked up. People get sentences of 25+ years for dealing drugs. I know what she did was a heinous crime, and she should get a substantial amount of prison time for it, but one has to look at the context of what she did. She was trying to get out of a godawful situation. To treat her crime on the same level as, say, Melinda Loveless, and take her entire life away like this is so sad. What a fucked system. Depressing.

Wasn't she granted clemency by the gov of CA this month (Jan. 2011)? I'm pretty sure, which means 25 years to life, with the possibility of parole. I'm happy about that.
When you are tried as an adult, the court considers you an adult for their own purposes. If you are aquitted, they say "we are sorry we arrested you incorrectly, determined you were an adult for the trial but now that is over and you are a child once again" What an injustice. If they were truly adults in the eyes of the law they would STILL be adults afterwards, that is, they could sign contracts, vote, marry, drink etc. If they are unqualified for those things they are not adults til of age.
It's quite simple. Do not murder people, especially family members. Do not request that others do so for you. That is the law in America, and all Americans know the consequences.
All murderers have an excuse, and hers is just that. Unproven. But even if true, this murderer could have gone to other family members, police or other authorities for help.

It's just a legal conundrum. If they are tried as Juveniles in juvenile court, then they get a juvenile sentence. This means that a 16 year old could commit just about any hideous crime imaginable, yet still be released by the time they're 21. When they use to run Juvenile murderers and rapists through the juvenile system it resulted in high recidivism rates, pressuring courts to impose more appropriate consequences on violent juvenile felons to protect the public.

@TCHill19 before you shoot your mouth off understand in florida the only sentences you can get is life without parole or death. if she were 18 she could technically have gotten death but since she was 16 it was life. i know it may not seem fair but you can't blame the judge as it is the only sentence he can legally give. at least in florida you have to be 10 to be tried as an adult, in pennsylvania there is no age minimum. any age that murders is automatically sentenced to life there.
@TCHill19 or in other words the show cold case which i rarely seen basically means all those people you see being arrested are basically going to spend the rest of their lives there. i heard there was an episode where a 10 year old was arrested for killing someone at 5 on the show once, and in that state he would be tried as an adult even if he had been 5 at the time of his arrest. in pennsylvania you can technically be sentenced to death, but not likely, as none have happened in 15 years.
@TCHill19 the same is technically true under michigan law but it is easier to be tried as a juvenile. generally the only juveniles they ever try as adults are those who premeditated the killing or killed more than one person, but there have been people as young as 13 arrested there also. in pennsylvania there are currently 450 people under 18 serving a life sentence, plus another 4,000 serving life that are older than 18 for something they did when they were younger than 18.

@EnglanderUK the judge has to give life without parole. in florida 1st degree murder is either life without the possibility of parole or death. since she was under 18 she could only be sentenced to life. the judge could technically acquit her if he wanted but the problem was she at one point admitted to having ordered her father's death. and if you acquit somebody and it turns out they really did do it they can't be sentenced a second time for the same thing.

@deweytrux for me i don't have anything against life sentences for murder, violent rape/abuse and extreme cases of robbery and terrorism, but i also believe people should be eligible for parole after a certain time. the problem is there are only 7 states in the USA where murderers can be eligible for parole. technically new jersey has parole but you must serve at least 63 years of a 75 year life sentence to be eligible. that means you'll basically be in your 80's when you can apply.

@volodymyrm1 well if you don't want to see this then start changing some laws. because in florida this is the minimum sentence a judge could give. and remember during her sentencing, there was a brief period where prosecutors wanted the death penalty, but the judge denied it and made it a life sentence. since back then it was not yet illegal to hand over a death sentence to kids who committed a murder before march 14 2005. it was only in 2007 after a 2 year moratorium that juvenile death ended.

This is weird because there's a documentary (Every F---ing Day Of My Life) about a woman who killed her physically abusive husband with the help of her son and they were both sentenced to ten years in prison. I don't see how a kid who didn't actually take part in the murder could a sentence worse than an adult who did.

If my son were to murder me I would never want him to spend life in prison which is a fate worse than death. If I were capable I would forgive him and I would only want him to get physiological help. After seeing this and living in Florida as well makes me feel that maybe I should write something similar a will demanding this not happen to my kid in case it ever happens even though the self righteous prosecutors would ignore my wishes...shooting her in the head that would of been more humane

and i was charged as an adult at 13, and they said to me i was looking at 2 years in juvie, but i took the deal because i wanted not to go jail. And if i didn`t abide by probation i would get 60 days added onto a 2 year sentence. And this person got murdered and charged as an adult but i didn`t kill no one and still got charged as an adult. Pathetic on all boundaries. Fuck the justice system

You know what`s even more fucked up. I`m in Canada and got Charged with Threatening and Threatening with a Deadly Weapon, even tho the gun was not loaded, and the other teen that i threatened was a block away. He called the Cops, i got arrested, spent the night in jail, i got printed, went to video court, then had to go to provincial court, and then i was notified i was being charged as an adult, my dad got me a lawyer .And my lawyer made a deal. I got 1 year probation and 50 hours.Got adult tho

JUVENILES SHOULD NEVER BE TRIED AS ADULTS. Our justice system is so hopelessly fucked up. People get sentences of 25+ years for dealing drugs. I know what she did was a heinous crime, and she should get a substantial amount of prison time for it, but one has to look at the context of what she did. She was trying to get out of a godawful situation. To treat her crime on the same level as, say, Melinda Loveless, and take her entire life away like this is so sad. What a fucked system. Depressing.

Wasn't she granted clemency by the gov of CA this month (Jan. 2011)? I'm pretty sure, which means 25 years to life, with the possibility of parole. I'm happy about that.

When you are tried as an adult, the court considers you an adult for their own purposes. If you are aquitted, they say "we are sorry we arrested you incorrectly, determined you were an adult for the trial but now that is over and you are a child once again" What an injustice. If they were truly adults in the eyes of the law they would STILL be adults afterwards, that is, they could sign contracts, vote, marry, drink etc. If they are unqualified for those things they are not adults til of age.

It's quite simple. Do not murder people, especially family members. Do not request that others do so for you. That is the law in America, and all Americans know the consequences.
All murderers have an excuse, and hers is just that. Unproven. But even if true, this murderer could have gone to other family members, police or other authorities for help.
The world is a safer place when killers are behind bars.

This whole trying a child as an adult doesn't make sense to me. if a 16yo murders they are assumed an adult and knew what they were doing............but....when a 16yo has an affair with her school teacher (I knew of a case like this) she's suddenly too young to understand what she's doing.........she understands murder but doesn't understand sex with her teacher?? Makes no sense.

It's just a legal conundrum. If they are tried as Juveniles in juvenile court, then they get a juvenile sentence. This means that a 16 year old could commit just about any hideous crime imaginable, yet still be released by the time they're 21. When they use to run Juvenile murderers and rapists through the juvenile system it resulted in high recidivism rates, pressuring courts to impose more appropriate consequences on violent juvenile felons to protect the public.

i feel sorry for her, but she planned and carried out a murder with her b'friend. would have been best if she'd put her father away for life for raping her. and i realise it can be tough for some ppl to confront these issues. but look at where its got her. she not only ended her fathers life, but in effect ended her b'friend and her own life in the process.

i agree juveniles should not go unpunished and can serve time in adulthood if the parole board agrees, i may even agree with her serving time in a detention centre for a certain amount of years as some sort of punishment since the court never proved it was premeditated but shows she tried hiding evidence. i know in pennsylvania if you commit murder you're automatically an adult and they only give life sentences.

@th3w3rks The judge sadly had no alternatives to decide between - life without parole was mandatory for 1st degree murder under adult law (and she was tried under adult law, though she was only 16 at the time of the murder).
A couple of issues have gone completely wrong here.

@TCHill19 before you shoot your mouth off understand in florida the only sentences you can get is life without parole or death. if she were 18 she could technically have gotten death but since she was 16 it was life. i know it may not seem fair but you can't blame the judge as it is the only sentence he can legally give. at least in florida you have to be 10 to be tried as an adult, in pennsylvania there is no age minimum. any age that murders is automatically sentenced to life there.

@TCHill19 or in other words the show cold case which i rarely seen basically means all those people you see being arrested are basically going to spend the rest of their lives there. i heard there was an episode where a 10 year old was arrested for killing someone at 5 on the show once, and in that state he would be tried as an adult even if he had been 5 at the time of his arrest. in pennsylvania you can technically be sentenced to death, but not likely, as none have happened in 15 years.

@TCHill19 the same is technically true under michigan law but it is easier to be tried as a juvenile. generally the only juveniles they ever try as adults are those who premeditated the killing or killed more than one person, but there have been people as young as 13 arrested there also. in pennsylvania there are currently 450 people under 18 serving a life sentence, plus another 4,000 serving life that are older than 18 for something they did when they were younger than 18.

Money is taken out of school systems and directly/indirectly funneled towards the penal system. It's scary the way the future is shaping up and not too many seem to be aware or even care.

@EnglanderUK the judge has to give life without parole. in florida 1st degree murder is either life without the possibility of parole or death. since she was under 18 she could only be sentenced to life. the judge could technically acquit her if he wanted but the problem was she at one point admitted to having ordered her father's death. and if you acquit somebody and it turns out they really did do it they can't be sentenced a second time for the same thing.

@deweytrux for me i don't have anything against life sentences for murder, violent rape/abuse and extreme cases of robbery and terrorism, but i also believe people should be eligible for parole after a certain time. the problem is there are only 7 states in the USA where murderers can be eligible for parole. technically new jersey has parole but you must serve at least 63 years of a 75 year life sentence to be eligible. that means you'll basically be in your 80's when you can apply.

@volodymyrm1 well if you don't want to see this then start changing some laws. because in florida this is the minimum sentence a judge could give. and remember during her sentencing, there was a brief period where prosecutors wanted the death penalty, but the judge denied it and made it a life sentence. since back then it was not yet illegal to hand over a death sentence to kids who committed a murder before march 14 2005. it was only in 2007 after a 2 year moratorium that juvenile death ended.

I don't usually have a problem with life sentences when it's deserved, but this seems so sad. Especially since she was abused by her father and was under 18 at the time of the crime. Surely she deserves another chance someday.

@forestskog what do you consider kids? either you support life sentence or you don't. for me i do not support life without parole sentence for either juveniles or adults. i believe 1st degree murder can be a mandatory life sentence at any age but each age group and those with severe mentality might be eligible for parole at an earlier date. also if you want to be effective you must allow day parole somewhere during the sentence so prisoners can re adapt back to society.
