The standing doctrime is confusing and inconsistent. Check out Raines v. Byrd, its very similar to this case, the court dismissed it for lack of standing.

@TS175 If there is a fight between branches of government, or if the court thinks it's a problem best dealt with at the ballot box, the court doesn't want to get their hands dirty so they call it a political question and dismiss it. Also, sometimes NO ONE has standing to bring suit for certain things, so we just have to try to deal with it through the policital process. For example, I think not only do members of congress not have standing, but you or I won't either in this situation. It's silly

My only question would be why Kucinich is even bothering with a law suit. You don't need a judge to exercise your authority. Congress is the sole authority to exercise aggression for any purpose, by declaration of war. Congress is authorized to collect taxes for common defense, any expenditure of the military other than defense is unconstitutional without a declaration of war. The law is clear, impeach, and to any who stand in the way burn them at the stake in the media.
