  • The entire arrest, itself, was an act of obstruction of justice. See, the guy arrested had sued city officials for election fraud. All he did was attempt to obtain records (which is his right as per the Freedom of Information Act), yet, to further cover up their obvious crimes, those city officials had him arrested. The mayor, city council, and the police department were all in on this cover-up.

If the person was demonstrating on private property and the owners asked the police to remove the person, then they served their job by dragging him out.   • The officer did not follow through with it - which was a good thing for that officer - as it is now the Chief who is solely responsible for the activities of that day. Otherwise that officer would be subject to the legal liabilities that will be brought upon the Chief.

    The Chief responds "Yeah if you don't get up."

    Which part of that do you not understand?

  • The use of such force can only be PROPERLY (and lawfully) used to PROTECT the officers or the public from the threat of harm or actual harm from the individual.

    Mr. Grapski at no time posed a threat to any of the officers nor to the public.

    You did miss, apparently, the Chief ordering the Taser. The Chief orders the officer to pull out the Taser. You see him and hear him do this. The officer does so and aims it at Mr. Grapski.

  • Furthermore you conveniently ignore the issue here - and that was the threat of the use of force against an individual PASSIVELY resisting an unlawful arrest. Even if the arrest was LAWFUL - the use of force or the threat of the use of force in order to get a person to ACTIVELY participate (or cooperate) in the arrest is inappropriate and unlawful.

  • The use of force and the use of the power of arrest in the instance of a lawful issue of trespass has been long determined in the State of Florida (and is supported by case law) to be an INAPPROPRIATE use of the power of arrest.

    There was no need to arrest Mr. Grapski - and no lawful basis for the arrest.

  • The Governor of Florida ABSOLUTELY has authority over the Chief of Police. The Governor has the authority to suspend, remove, or replace the Chief of Police.

    There was no "crime" of trespass. Mr. Grapski had a RIGHT to be present and participate at the City Commission meeting. And he did not disrupt the meeting at all.

  • A person who dies because of blood loss DUE TO a gunshot wound died because of the loss of blood. What caused the loss of blood? The gun and the bullet.

    In a Taser incident the electrical current is the method of causing the death - which is caused by heart failure, etc. The cause of the heart failure is the Taser not the heart. (In other words if the Taser was not used - the person would not have died. Thus the CAUSE of death was the Taser).

  • If a person died due to a gun shot wound, the ME report will list the cause of death as "gun shot wound."

    So again, still looking for the death that the Taser casued.

  • The City of Alachua categorizes the Taser as Lethal Force of a lesser nature than a gun. (For those who need a lesson in the English language "lethal" and "deadly" are synonymous - that means they mean the SAME thing.).

    The Taser has been the CAUSE of death in over 200 cases in Florida alone. The MEDICAL cause of death and the INSTRUMENT that caused that are two different things.

  • I wouldn't make such conclusions that this man is necessarily resisting an UNLAWFUL arrest until you understand what has happened prior to the footage shot. Oh, and I must have missed the portion where the Chief orders the taser, since I notice the man isn't tasered... And finally a taser is classified as Level 1 Force in most departments, along with hair-holds, arm-bar, escort holds, etc. these are all in lawful responses to PASSIVE RESISTANCE.

    And no, "resisting" - particularly PASSIVE resistance (which you hear the officer state is how Charlie is resisting) - does not AUTHORIZE police to "subdue" an individual. For that the individual has to pose A THREAT to someone.

First off, I've noticed that tasers and other weapons used in anything other than self-defense tend to cause more public unrest than any officer should want. Second off, they seemed to be doing alright by carrying him, I hardly see how the taser was necessary.

  • The individual in question did not "disrupt" anything. And one does have rights even if that were the case. And certainly it is well established that the use of the arrest - and particularly the use of force - in such an instance as someone speaking in a "disruptive" manner (if that occurred) is inappropriate.

    And there is a right to passive resistance - particularly when you are resisting an unlawful order or arrest.

    The order was unlawful therefore one has the right to resist.

    The Governor of the state DOES have the authority over the police chief.

    The Alachua Police Department Manual (as well as all others) defines the Taser as deadly force.

    In spite of Amnistey International claims, I challenge ANYONE to post a medical examiners report in which the Taser was the actual cause of death. A Taser is NOT deadly force and has saved lives since its introduction into law enforcement.

  • Police do have the right and obligation to use force on anyone RESISTING arrest, be it passive or physical. Pain compliance or chemical agents can be used on subjects pasively resisting... i suggest you read a use of force manual sometime before you fly off at the mouth.
