I hate the music industry...I read of profits going to non musicial lawyers... songs written by many celebrities stolen like the Beatles and we are suppose to honor IPR for the sake of the thiefs .... if you made money on a cover I can see a portion but if you do a cover I don't remember any one getting paid for advertisting their property

  • Much of the public has been brainwashed into thinking that conventional "Intellectual Property Rights" (IPR) laws are a righteous effort to protect human rights, specifically property rights.

    In fact, they are no such thing.

    So-called IPR laws trample over individual rights and individual freedom.

    If a person hears a song, memorizes it, and sings back, either on the street or on the Net, how has he "violated another's rights?" How has he "stolen" another's "property?"

  • The record industry is like King Canute, telling the sea to fuck off. Unfortunately they still have a lot of money to burn through before they become completely irrelevant.

  • This RIAA movement is a tool of the lawyers and middlemen to suck as much money out of the public and the artists as they can. They started with the CD movement which destroyed the market when instead of decreasing the price due to lowering costs, they doubled it forcing people to pirate. Then they ruined albums with the Itunes thing. The RIAA and others are also going after guitar hobbyists when they interpret songs they've heard and share them in blogs and groups. Pathetic. Not funny.

  • Yes, it's ridiculous, but that is the law now. It doesn't matter that he's not making money. "Busking" is in fact a violation of copyright law. It's rarely enforced against buskers, but harassment of buskers by ASCAP agents is not completely unheard of. If Google got their lawyers on it, they would lose. The law is clearly on the side of the copyright owners. And no, the publishers obviously don't understand that this kind of free advertising is to their benefit.

  • In the case of "stars" who are very popular partners or on commercial "branded" channels, it's possible that they have actually purchased licenses to do the covers, but that's not feasible for "regular" YouTubers. You're right, it's ridiculous, because there's millions of videos that violate copyrights but the spotty enforcement results in just a few users being picked on with sanctions.

  • You are fully entitled to post your covers, under the TOS it's allowed. I encourage you to go read up and go press all the little buttons to dispute the copyright claim notices they sent you.

    I've done this before, and videos have been Instantly reinstated. I kid you not.

    You are NOT entitled to post covers. This has nothing to do with TOS. Posting cover songs is a violation of copyright law. Doing what you suggest is risky. Filing a counter claim against the actual owner of the copyright leaves you vulnerable to a lawsuit. Filing a specious counter claim is a crime. Doing so can get your videos reinstated, but you might end up in big trouble, especially if you do it repeatedly.

  • That's strange, I should go back and read it some more. TOS is so ambiguous it's hard to tell what's what anymore.

  • I repeat: this is not a TOS matter. Infringement on a copyright is a matter between the copyright holder and the user who posts the video. YouTube's policies are irrelevant.

  • I'd agree but, after being flagged myself, it depends on how they approach it. Certainly, if monetary gain results from the use of the copyrighted item, it will engender a court fight especially if one wants to defend himself for the charge.

  • Copyright is such an important thing so blatantly abused. This sucks, Isto. I shall subscribe to the others and continue never buying music.

  • Making your videos private might not protect them from being discovered by the copyright cops, so I'm glad you're opening other venues. I wish I had the luxury of boycotting Warner Chappell songs, but they own such a large chunk of the vintage popular songs I specialize in that taking them out of my repertoire would cripple my act. I would be happy to pay a reasonable fee for the privilege of posting covers here, as I do when I arrange concerts, but there's no way to do that under current rules.
