I can't see the Sherman Anti-Trust Act ever being used again in this globalized world. Even if we put aside constitutional interpretations, and, I believe O'Reilly was alluding to how the Roberts Court would interpret constitutional powers, there's no way you break up any American firm facing the state-subsidized firms abroad. You can't touch Boeing as long as there's an Airbus out there.
I love his program, but the YT administrator definitely need to disable commenting - the Youtube community is going to unleash vitriol and hate quickly on anything labeled O'Reilly.

He was saying the government splitting up companies on a whim without any justification is not constitutional. Only if they start to go down the monopoly road will the government intervene and regulate.
O'Reilly never said that, he said "all [the government] can do is regulate the company so it doesn't violate monopoly laws", when we know that the government can and has broken up companies when they "start to go down the monopoly road".
