The outriggers weren't pinned. He probably started to tip then the outriggers slid in and when that happens especially with that much stick out you are screwed.

On this crane that setup is only to be used with outriggers at full extension and boom angle higher than 45deg look at the boom jack and position of crane it was boomed down way below 45deg. As bad as I hate to blame an operator (I use that term lightly) unless there is something I don't know it his fault.

Yep. They push their luck and exceed the ARM specifications of the crane. The farther out a load is from a center point, the greater its effective weight becomes. You can suspend a 5-pound pail of sand from the elbow of your outstretched arm easier than you can in your hand; It feels much heavier there. That's the concept of ARM. Just like in a plane: If a load shifts back to the tail, the plane will pitch up, stall and fall.

Some states allow that injustice to happen all the time. If he was non-union, he would be fired. As a union worker, he would get a warning, maybe on his second or third time he might get fired.
