You have to actually be a beast, and watch the entire video without blinking, otherwise it doesn't work. When it tells you to look away, start blinking like crazy, and you'll see a less then neat image.

I see it. I think you're not supposed to end up with your eyes all watery, but there is an effect when you stare at the centre of the picture for some time and then look away (preferently, look at a white wall). It's a sort of dim neon light effect.

I don't think you can sue this fella, for he is not charging you for watching this video or ripping you off in any way...
