If you are close enough to hit that vehicle when you are rear ended, you are too close, therefore at fault. It's in the driver's handbook - look it up.

In my state, from this video evidence, the driver who hit the first car is at fault for all of it. The car is fully on their breaks and was hit by a much bigger SUV. ....the car changed lanes at :08, and didn't apply his brakes until :013. The SUV had 5 seconds to slow down. And that's all they had to do was start applying the brakes and slow down. But he just kept coasting and even sped up until he rammed right into the back of the car.

First of all, the SUV wasn't going that fast at all when the other car switched into their lane. Watch the video again. If you notice, the brake lights on the SUV never came on, which means that the driver NEVER even applied the brakes. That means that they weren't even paying attention. At about 0:10, they even start to speed up! It was like the SUV just coasted right into the back of the other car. They weren't paying attention.

@felicianomiko Actually, law says if you are hit and you jerk forward enough to hit the car in front of you, you are at fault for tail gating. The original guy gets a ticket for hitting you, but you get a ticket for hitting the other guy.

@felicianomiko Yes it does. Law states you are supposed to be far enough away from the vehicle in front of you so you can see their rear tires on the pavement. If you are close enough to hit that vehicle when you are rear ended, you are too close, therefore at fault. It's in the driver's handbook - look it up.

@Dora1692 In what state is that the case, because states do vary on their laws. There are also mitigating circumstances. In my state, from this video evidence, the driver who hit the first car is at fault for all of it. The car is fully on their breaks and was hit by a much bigger SUV. Physics will not be denied, no matter the letter of the law. Makes me glad I'm not in California.

....the car changed lanes at :08, and didn't apply his brakes until :013. The SUV had 5 seconds to slow down. And that's all they had to do was start applying the brakes and slow down. But he just kept coasting and even sped up until he rammed right into the back of the car.

The driver of that SUV is a total idiot. They never even applied their brakes at all, and they had plenty of time to stop. They weren't paying attention...yup, they were probably talking on a damn cell phone.

@ct92404 the driver of the SUV had less than a compact car lenght to stop and less than 3 seconds to break when the driver of the car that swiched lanes break lights when on. It is physically IMPOSSIBLE for the SUV to stop that fast while moving at that speed... cont

First of all, the SUV wasn't going that fast at all when the other car switched into their lane. Watch the video again. If you notice, the brake lights on the SUV never came on, which means that the driver NEVER even applied the brakes. That means that they weren't even paying attention. At about 0:10, they even start to speed up! It was like the SUV just coasted right into the back of the other car. They weren't paying attention.

@ct92404 .I will keep saying it.. that car that switched lanes in that situation is just as responsible for that accident as the SUV driver is. Sure the SUV drivers insurance WILL be paying for the repairs, but that accident doesnt happen if that driver doesnt switch lanes either.

The driver changing lanes like that is just as much at fault (if not more so) than the person who rear ended her. Changing lanes when traffic is about to stop like that is just ASKING for an accident.

@ambigroove The car signaled and entered the lane with plenty of space and time. They were only going 20- 25 mph. That driver that changed lanes had nothing to do with the moron who was looking at something else. Look at the video again. The SUV never hit the brakes until after the crash and had they been looking they could have stopped twice in the ten seconds they had.

3. The driver changed lanes and then had to slam of his breaks hard causing the SUV behind to rear end him. If he hadnt come across to lanes of highway like an idiot when traffic was about to stop, it wouldnt have happened.

Anyway, the break lights of the suv infront of the car went on for a moment before the car went into that lane. Right there if he wasnt a MORON, and was actually paying attention to the cars in the land he was switching to, he would have decided not to go into that lane. Why would you switch lanes behind a car like that, that was indicating he was slowing down? Its common sense. But then again. most american drivers...
