Instead of sleeping in at night he should get his FAT A** out of bed and exercise. UGH! He carried the issue too far. I would do anything to get him to sell his house and get him out of the neighborhood.

In Idaho if a neighbor installs a fence on a property line to establish a physical boundary between properties that person can by law force the neighboring property owner to pay for half the costs of the fence that borders their property whether they wanted it or agreed to it there or not because the law inplies that the neighbor benefits from the fence too.
Property law here is very simple, if neighbour has a fence and it's on your property, she/he MUST move it. If They fail to do so, that would give you the right to do it for them or even tear it down, after all, it's on your property. If neighbour wants to build a fence and you say NO, I don't allow it, there will be no fence.
When my parents bought their house, there was a tree right up against the fence. After a couple of years the fence was starting to bend so there were two choices, cut down the tree or move fence closer to the next door neighbor. They decided to move the fence. The house has been sold twice since then, I don't know if the neighbors know, but I don't think they would care anyway we are only talking about six inches.
JM had the wrong attitude abut the amount of land. No one has a right to encroach on your land I don't care if it's two inches. Good fences make good neighbours. But put them on the property line.
Sorry, defendant is totally wrong; she should have checked her plat and had a survey done BEFORE she put the fence in, that was totally wrong on her part.

Its not just a few inches, the bitch took 2 and a half feet from you. He would not be able to sell the house with her fence on his land. The house needs to pass a inspection befre it can be sold and the inspector would never pass it as long as the ladies fence is resting on his property
@Asalino1 They can pass the inspection. We went through the same thing with hedges on our property that made the land smaller than what was supposed to be there.
It was noted in all inspections, but as long as the perspective buyers knew about it and didn't care, then it was fine.
We had one set of buyer who wanted us to move the hedges back. As if. We decline that offer, of course.

It didn't take much away from our enjoyments of the backyard, so I didn't complain. When we sold that house I made sure the buyers knew. If they are so anal they have a problem with it, then they could deal with it after the sale.
I'm not about to start a fight with neighbours over something so small.
