Actually, the claims would have never been paid. The fishermen and tourist operators would have gone for years and years and gone bankrupt and become homeless and simply faded away.
And the prime motivation for BP is NOT dividends for its shareholders, but giant bonuses for their executives. Just like Bear Stearns and AIG and the rest of them.

If the criminal prosecutions get put on hold because of this fund, it was improper. If the money is doled out judiciously, it will be a good thing. If the Democrats don't raid it to extend unemployment payments like they tried to do with another oil spill fund, it will be a good thing.

The president can send troops for case of marshal law. That is not the same as having someone jailed and sentenced. That the DA's job, now the president can encourage the DA to take the case but that doesn't mean he can order such a thing. He can encourage the system to start the process of due process, but he cannot guarantee the punishment or outcome. So again, What could he possibly threaten with that is not already on the table?

That being said, a company like BP should not have any cap to liability. If they can't afford it, they should not drill.
