Yeah, Sonic never swam. He was underwater, but he didn't actually swim,. And sometimes he was able to float (For plot purposes, mainly in AoStH), but not swim. Sonic Unleashed did it cool though, running on the water was just awesome.

I'm not sure if Moby Dick is in the public domain or not. The issue is probably a legal one. By not using the name "Moby Dick", the scene doesn't step on any toes as far as copyrights are concerned. If the book is public domain, though, then it's possible that they just didn't want to blatantly rip it off for the scene.
