They can also use reasonable force to detain you for a reasonable amount of time during that investigation. Not only will you lose your lawsuit terribly, you'll end up with a free ride in a police car. Now thats assuming that you stole, if you didnt then they wouldnt stop you at the door. My information came from A) A related news report about Walmart policy B) An employee of Walmart. The person that challenged you may not have been a Walmart employee but rather a security company under contract. This is their job, not that of greeters and stockers. It's in Walmart's best interest to let a DVD walk out of the store rather than to have an employee get killed over such a petty loss. The hired security outfit has their own liability insurance against loss prevention gone bad.
Why did you even stop? If the alarm goes off, it doesn't mean you have to stop at all.

@pm0501 Apparently not true. I was accused of stealing at a Walmart (not guilty) after I walked to my car after leaving. One of their employees followed me to my car and asked for the receipt, which I refused. I drove off and got pulled over, etc. and ended up with a gift card because I threatened to sue.
In short, if they aren't allowed to chase people or they get fired, that's not what happened to me. The same guy was working there a month after this incident.

Ive done Asset protection at walmart. you know they had no right to stop you and you can sue for harrassment. The company policy is that AP has to see the 5 steps to make i proper stop
1)See you make selection
2)see you conceal the merchandise
3)keep constant vision on you
4)pass all points of sale fail to pay for the merchandise

Why did you even stop? If the alarm goes off, it doesn't mean you have to stop at all.
I'm guessing you stopped and got into the whole charade with the employees for "fun". If not, if it ever goes off again, smile and keep walking. You aren't legally required to stop.

@pm0501 Apparently not true. I was accused of stealing at a Walmart (not guilty) after I walked to my car after leaving. One of their employees followed me to my car and asked for the receipt, which I refused. I drove off and got pulled over, etc. and ended up with a gift card because I threatened to sue.
In short, if they aren't allowed to chase people or they get fired, that's not what happened to me. The same guy was working there a month after this incident.

you leave the parking lot and it's the cops job
but usually the cops will be there before you get the chance to drive away, or even if you do drive away you license plates and car description will give you away
better off just removing the metal tags and walking out casually
or buy something else cheaper to take away the suspicion of walking in and out with what appears to be nothing

Ive done Asset protection at walmart. you know they had no right to stop you and you can sue for harrassment. The company policy is that AP has to see the 5 steps to make i proper stop
1)See you make selection
2)see you conceal the merchandise
3)keep constant vision on you
4)pass all points of sale fail to pay for the merchandise
5)make the stop
If this happens again ask if the followed AP09 LOL AP09 is the guidlines we have to follow

Wait can i sew walmart? Cause The beaper went off on one of my friends and he didnt notice. So he just kept going. So they called the cops on us and said we stole a scooter. So we were like WTF? Then we settled everything out with the cops. But he said that the walmart people don't want us back in the store now and we didn't do a damn thing wrong. So can i sue?

first off, yeah sue them but they have to take on security measures. They can show the video as evidence. What can the lawyer say they were jus stupid ass kid who put tags on each others hoodys and wanted everyone to steal by making the put their focus on 3 prats, I doubt the family would win, they will lose more money on lawyer than get a reward.

I used to work for walmart doing security for them. unless they followed the 5 steps they have no reason to stop them or detain them no matter what alarm is going off. thats the reason the home office came out with AP-09 cause they get sued alot cause of that door alarm. now not sticking up for these kids for acting stupid just stating the facts. in most lawsuits the people dont have to pay anything unless they win and walmart would settle out of court would cost walmart more to fight it.
