Mais son avocat a expliqué que Ndokula Mobutu, 25 ans, était bloqué à Rabat dans l'attente de pouvoir quitter le territoire marocain. Il n'est pas parvenu à se procurer un visa pour la Belgique. Mais il compte venir s'expliquer ultérieurement devant la justice belge, semble-t-il.

Par ailleurs, l'Etat garde la caution de 3,8 millions que Ndokula Mobutu avait dû déposer pour retrouver la liberté après trois semaines d'incarcération préventive.Une des conditions pour récupérer cette caution était de se présenter à tous les actes de la procédure. Il n'a pu venir à son procès: il a perdu ses 3,8 millions.

Ndokula Mobutu est donc condamné pour avoir tenté de se faire remettre frauduleusement la somme de plus de 3,8 millions. Pour cela, il écope d'une peine d'un an de prison ferme et d'une amende de 200.000 F.

Le jugement de la 55e chambre du tribunal correctionnel de Bruxelles reconnaît que les fausses mentions n'ont pas été apposées par le fils Mobutu. Ceci avait d'ailleurs été attesté par un expert en graphologie. Ce n'est pas lui qui a écrit les mentions, explique le jugement, mais il y a son adresse personnelle qui figure sur le document. Et le prévenu ne peut expliquer comment une tierce personne aurait pu apposer ces mentions, souligne le tribunal.

En fait, Ndokula Mobutu a été condamné pour faux et usage de faux, ainsi que pour une tentative d'escroquerie. Un ordre de virement de plus de 3,8 millions avait été adressé à son compte bancaire personnel. Mais avant d'être honoré, le document a été soumis à quelques vérifications. Au cours de ces opérations, la banque s'aperçut qu'il s'agissait d'un faux.
