I think it's clear to all why someone like Finkelstein would be denied tenure. Israel's strike on November 4th was a response to an act of war on the part of Hamas. From an international legal standard, Hamas' building a tunnel to abduct a soldier can certainly be considered an act of war, and in so being an act of war, it was a violation of the spirit of the ceasefire. Israel responded in a legal preemptive fashion.
